Abstract

Julian Staben examines chilling effects, framed as deterrence-based lines of argument, in the jurisprudence of the Bundesverfassungsgericht (German Federal Constitutional Court) and compares them with the jurisprudence of the US Supreme Court. Chilling effects follow distinct patterns when it comes to online behaviour and emerging digital practices and therefore call for their constitutional reassessment. Julian Staben's work enables a more methodologically reflective use of these arguments in the judicial discourse.

Abstract

The link between leisure and contemplative activity, as paradigmatically developed in Aristotle's Nicomachean Ethics, has a pre- and long post-history reaching into present day philosophy and theology. Aristotle's melding of leisure with theory is explained anthropologically because human nature's capabilities are perfectly realised in a contemplative form of life. The contributions in this volume investigate models of connecting theory and leisure in the history of ideas with regard to the question of an anthropological foundation of theory.

Abstract

The contributors to this volume discuss the formation and transformation of ancient concepts of authorship, specifically among those types of texts that are classified as “religious literature” – whether Greco-Roman, early Jewish, and early Christian. In twelve case studies spanning the time from Ben Sira to Tertullian, various ways of how authors considered themselves to be individual producers of texts and religious voices are carved out. The volume presents authors who fashion themselves either as orthonymous, anonymous, or pseudepigraphic writers, and who share the idea of being “religious agents”. The search for these religious voices undertaken here is a valuable contribution to both research in ancient “Autorforschung” and the religio-historical study of how religious knowledge was produced in the ancient Mediterranean world.

Abstract

The dietary prohibitions in Leviticus 11 and Deuteronomy 14 represent one of the most detailed textual overlaps in the Pentateuch between the Priestly material and Deuteronomy. This is especially the case for the birds: their identities are shrouded in mystery and the reasons for their prohibition debated. Peter Altmann attempts to break this impasse by setting these flyers within the broader context of birds and flying creatures in the Ancient Near East. His investigation considers the zooarcheological data on birds in the ancient Levant, iconographic and textual material on mundane and mythic flyers from Egypt and Mesopotamia, as well as studying the symbolic functions of birds within the texts of the Hebrew Bible itself.

Abstract

The decline in birth rates in advanced economies is not a new phenomenon. Between 1880 and 1900 birth rates dropped from 5.5 children per woman to 2.5 children per woman. A further decline from 2.5 to 1.5 or even 1.3 children took much longer – about 80 years. One of the most apparent causes is, however, widely ignored. Beatrice Scheubel tries to fill this gap. According to the so-called Social Security Hypothesis, insurance against the risks of life (i.e. poverty for all sorts of reasons, in particular, age) by the state crowds out all types of private insurance. One of the (vast) different possibilities to privately insure oneself against poverty is having children. That is why it should not be surprising to witness falling birth rates given the sheer magnitude of the welfare state. In this book, Beatrice Scheubel analyses the effects of the first comprehensive system of social security, which was introduced between 1883 and 1891 in Germany.

Abstract

Was the author of the Pastoral Epistles only a purveyor of other men's Christology? Or is the Christology of the Pastorals the author's own? Does this Christology fall back on a level below Pauline Christology or does it go far beyond it, as some would have it? Hanna Stettler shows that the author was true to Pauline thought by not just repeating what Paul had taught but rather by reinterpreting it for his current time in the Hellenistic language of his days. For this reason the language of incarnation and the parousia is transformed into the scheme of the twofold epiphany of Christ, the Messiah. The author of the Pastorals includes both Synoptic and Johannine thought in order to present a comprehensive picture of the person and work of Jesus Christ.
