Abstract

With this rich anthology of sources, most of which are made available here for the first time, Michele Mancino and Giovanni Romeo add another element to the research project that began with their recent book (Clero criminale. L’onore della Chiesa e i delitti degli ecclesiastici nell’Italia della Controriforma, Laterza, Roma-Bari, 2013, 4th ed.). The two parts document from a range of perspectives the way in which the Tridentine project of combating the common crimes of the clergy was undone before the end of the sixteenth century. Instead, the Roman curia was mainly concerned with enforcing the right of delinquent priests to be judged only by ecclesiastical tribunals, a strategy intended to defend the honor of the clergy that was followed persistently over the long term. The material presented here describes a previously unknown historical precedent for the recent revelations about the treatment of pedophile priests.

Abstract

What was the impact of the armies of the King of Spain on one of the territories of its composite monarchy during the centuries of the early modern age? What changes took place in the relations of power between the local institutions and the Madrid headquarters, between the Lombard corps and the city of Milan, between the representatives of the territorial corps and the power élites, as a consequence of the grievous burden represented by the military costs necessary for running the war? These are some of the questions that the author attempts to answer through study of the phenomenon of the military garrisons, an exceptional vantage point for observing the fine line that, in the ancient regime, divided the "military" and "civilian" worlds, which were not yet separated by the high walls and barbed wire of modern barracks.

Abstract

The D’Avalos name evokes images of cruel battles and tragic love stories, reminds figures of great warlords and sophisticated ladies, nourishes the legend of fabulous riches and luxurious residences. The work of scholars who explored the thick forest of Innico and Alfonso D’Avalos descendants do not allow to completely outline the history of this family. The family’s private archive, inviolable guardian of their memories, where records related to the private sphere and official acts, such as pontifical papers and relations with the sovereigns, are kept is still inaccessible. The records of the notary Scotto di Santolo can be very useful, because they allowed the reconstruction of the wide archival heritage coming from the past, recorded along with other property of the family after the death, in 1862, of last heir of the primary branch, the Prince Alfonso D’Avalos. The transcription of the D’Avalos archive before the Italian unification that we present can avoid its definitive "burial".

Abstract

The essays collected in this volume revolve around the activities of protection and preservation of the historical-artistic and archaeological heritage promoted in Italy between the second half of the 18th century and the first half of the 20th. They refer to different works in both chronology and materials analyzed (wall and gallery paintings, medieval and Renaissance sculptures, mosaics, excavated vases, entire archaeological sites), with the natural corollary of the theoretical debates and the methodological statements that accompanied these same works.The reference to Fernand Braudel in the title embodies the desire to trace a path that is not abstract, but grounded in the reality of the objects and of those who have been studying them in the past. The choice of a relatively broad time span, as well as the decision not to focus exclusively on a single type of object, seek to highlight the diachronic evolution of general concepts such as conservation and restoration, understanding links and differences between the pre-and post-unification phases of the layered national landscape. Further, they aim to retrace the conservative history of these works, hoping to also provide an interpretative tool to those who, in charge of the protection of these works, are tasked with the planning of future interventions: a proper programmatic preservation cannot, in fact, ignore the historical dimension that needs to inform any study that is to be done today on these works.

Abstract

During the 17th century antiquities of Campania received international attention thanks to the cultural politics of the Bourbon monarchy. The archaeological discoveries were considered part of the political and military success of the King of Naples. After the reunification of Italy, Naples lost its central role as heart of the antiquities collecting and trade as consequence of the marginalization of Naples as economic and political capital of a Kingdom. This process influenced the sectors archaeology, collecting and antiquity market that traditionally reflected the self-representation of the cultural and political élite. This book focuses on the social history of Neapolitan archaeology, that between the 19th and the beginning of the 20th century was strictly connected with the antiquarian market. The research analyses cultural, socio-political and institutional transformations that determinated the promulgation of a specific legislation that limited the exportation of antiquities with the aim to protect the national interest on Cultural Heritage.

Abstract

"Comparative law and the history of law are traditionally devoted to expanding the context of legal rules and legal institutions. Comparison involves history, as the well-known motto proclaims, but history also involves comparison. Both disciplines are in fact interested in deepening the space-time coordinates of law as a social phenomenon, which means that they take up a critical approach to their object of study.&#xD;In recent years, this trait is increasingly coming into conflict with the tendency to present law as a mere technocratic instrument for organizing societies. As a result of the »end of history« discourse, the Western economic and political order has become a definitive point of reference worldwide, with law scholars charged with identifying best practices to enhance their efficiency.&#xD;A group of comparative lawyers and legal historians critically discuss this assumption from a theoretical point of view as well as from the perspective of their respective fields of research. The result is a multifaceted range of ideas on the significance and possible future of two disciplines that share, in addition to their traditional approach, a crisis of identity."&#xD;

Abstract

"The spatiotemporal conjunction is a fundamental aspect of the juridical reflection on the historicity of law. Despite the fact that it seems to represent an issue directly connected with the question of where legal history is heading today, it still has not been the object of a focused inquiry. Against this background, the book’s proposal consists in rethinking key confluences related to this problem in order to provide coordinates for a collective understanding and dialogue.&#xD;The aim of this volume, however, is not to offer abstract methodological considerations, but rather to rely both on concrete studies, out of which a reflection on this conjunction emerges, as well as on the reconstruction of certain research lines featuring a spatiotemporal component.&#xD;This analytical approach makes a contribution by providing some suggestions for the employment of space and time as coordinates for legal history. Indeed, contrary to those historiographical attitudes reflecting a monistic conception of space and time (as well as a Eurocentric approach), the book emphasises the need for a delocalized global perspective. In general terms, the essays collected in this book intend to take into account the multiplicity of the spatiotemporal confines, the flexibility of those instruments that serve to create chronologies and scenarios, as well as certain processes of adaptation of law to different times and into different spaces.&#xD;The spatiotemporal dynamism enables historians not only to detect new perspectives and dimensions in foregone themes, but also to achieve new and compelling interpretations of legal history. As far as the relationship between space and law is concerned, the book analyses experiences in which space operates as a determining factor of law, e.g. in terms of a field of action for law. Moreover, it outlines the attempted scales of spatiality in order to develop legal historical research. With reference to the connection between time and law, the volume sketches the possibility of considering the factor of time, not just as a descriptive tool, but as an ascriptive moment (quasi an inner feature) of a legal problem, thus making it possible to appreciate the synchronic aspects of the ‘juridical experience’.&#xD;As a whole, the volume aims to present spatiotemporality as a challenge for legal history. Indeed, reassessing the value of the spatiotemporal coordinates for legal history implies thinking through both the thematic and methodological boundaries of the discipline."&#xD;

Abstract

Through the various essays that compose it, the volume gives voice to subjective experiences and perceptions of men and women involved in military conflicts between the Risorgimento period and the Great War: historical phases characterized by deep elements of continuity regarding the symbolic construction of national identity, but also by equally strong watersheds. The comparison between different contexts is valuable in investigating the relationship between gender, nation, and war. Starting from a stereotype that is still strong, though it has been challenged by recent research − associating women with the desire for peace and men at the will of competition and conquest −, the volume inquired whether a specific "gender" perception of wars emerged from the texts analyzed, and to what extent these conflicts have prodded crisis and transformation in the relations between women and men. In the writings of fighters analyzed in the book − Bourbonists and Garibaldians on the Risorgimento scene, British and Italian volunteers in the First World War − "fighting the war" assumes very different meanings in relation to the side that was chosen and to the individual personality; however, it always represents a crucial moment of confrontation with dominant models of virility. The writings of Louise Colet − a passionate supporter of the Italian cause −, the images of "angels" and "fury" emerging from the male memories of the Risorgimento, alongside writings of so many women mobilized in 1914-18 − from Vera Brittain to Italian irredentists and nationalists, to the feminist minority who remained faithful to pacifist internationalism − remind us that in the nineteenth century, as in the terrible conflict that opens the "age of extremes", the war transformed profoundly, in addition to the lives of men called cannot, in fact, ignore the historical dimension that needs to inform any study that is to be done today on these works.

Abstract

An examination of the literature sources, of the archival documents, of the iconographic and cartographic repertoire to reconstruct the key moments of the fascinating architectural and artistic history of one of the most famous monuments of our city. The Basilica of San Giovanni Maggiore is now the result of often ominous and even criminal events, or of some imprudent interventions, that the recent renovations have been able to remedy only partially. Nevertheless, thanks to the constant care and to the appropriate use by the Engineers Order of Naples, it has been lately given back to the city: not only as an important place of worship, but also as a cultural center and a social gathering site, placed in such a significant area of the historic center of Naples, UNESCO World Heritage since 1995. The architectural and artistic analysis of the Basilica has been preceded by a description of urban history in late Antiquity and in the early Middle Ages; it had its fulcrum in the hill of Monterone, now largo of San Giovanni Maggiore, with an irregular and tortuous web, preserved up to us. This work proposes in the second part an updated summary analysis of existing artistic works in the Basilica, as well as those placed in some other locations in order to be preserved or restored.

Abstract

In recent years the leader of "Giustizia e Libertà" has been the focus of a renewed and extensive attention. The author reconstructs the itinerary of Carlo Rosselli, conducting the theoretical analysis in the light of the complexity of the historic context. From the years of the Great War to the exile in France, intellectual meditation and political commitment are inextricably entwined threads in the career of the Florentine antifascist. In the attempt to pinpoint the key passages of this unquiet quest, the book traces the stages of an evolving thought. A thought that was matured through critical comparison with liberal theory and Marxist doctrine, found inspiration in English socialism and conceived opposition to the Fascist regime as the grounds for a project of progressive democracy.
