Abstract

The grand thesis that the spirit of Protestantism is one of modern capitalism's great driving forces originated from Max Weber. According to him, religious foundations of inner world asceticism, Luther's concept of vocation, Calvinism, and English Puritanism had a direct influence on the development of modern kinds of economy. The thesis was not undisputed and to this day remains a prominent starting point for discussions. What can be said now in the twenty-first century about the spirit of capitalism? Do ethics still hold any sway over global financial markets and systems of production? This volume's four authors seek answers to these and other related questions from different perspectives.

Abstract

Julian Staben examines chilling effects, framed as deterrence-based lines of argument, in the jurisprudence of the Bundesverfassungsgericht (German Federal Constitutional Court) and compares them with the jurisprudence of the US Supreme Court. Chilling effects follow distinct patterns when it comes to online behaviour and emerging digital practices and therefore call for their constitutional reassessment. Julian Staben's work enables a more methodologically reflective use of these arguments in the judicial discourse.

Abstract

The history of systems theory does not start with the rise of cybernetics in the post-war 20th century. It rather took off in the late 19th century's now largely forgotten organismic sociology. Authors like Talcott Parsons or Niklas Luhmann can't, however, be reduced solely to a single line of descent. Julian Bauer outlines the plural origins of systemic ideas by portraying their broad foundation in different strands of holist thinking and thus provincialises systems theory. His book charts the intellectual and visual culture of systems thinking between 1880 and 1980.
