Abstract

The thesis analyzes a treatment of dangerous criminals on society with viewpoint of comparative criminal law in Germany and South Korea. In particular, with a focus on "preventive detention" as a "measure of improving and security", at first, basic theory of the Measure of Improving and Security is referred for the analysis of Preventive Detention. At the end of the thesis possible alternatives to Preventive Detention are reviewed. As a result, duality of the criminal law and Measure of Improving and Security will have to be acceptable to the Criminal Code, but the focus of the criminal treatment of dangerous criminals should also be successful treatment and re-socialization, alternatives that do not deprive of freedom emphasized to hold a dominant position.

Abstract

This innovative interdisciplinary study focuses on the history, science, and policy of tree planting and water conservation in South Africa. South Africa’s forestry sector has sat—often controversially—at the crossroads of policy and scientific debates regarding water conservation, economic development, and biodiversity protection. Bennett and Kruger show how debates about the hydrological impact of exotic tree planting in South Africa shaped the development of modern scientific ideas and state policies relating to timber plantations, water conservation, invasive species control, and biodiversity management within South Africa as well as elsewhere in the world. Forestry and Water Conservation in South Africa shows how scientific research on the impact of exotic and native vegetation led to the development of a comprehensive national policy for conserving water, producing timber, and protecting indigenous species from invasive alien plants. Policies and laws relating to forests and water began to change in the late 1980s and early 1990s as a result of political and administrative changes within South Africa. This book suggests that the country’s contemporary policies towards timber plantations, guided by the National Water Act of 1998, need to be reconsidered in light of the authors’ findings. Bennett and Kruger also call for more interdisciplinary research and greater emphasis on integrated policies and management plans for forestry, invasive alien plants, water conservation, and biodiversity preservation.

Abstract

Between 1860 and 1910, Australian governments sanctioned and then tried to stop the trafficking of South Sea Islanders to Queensland as forced labourers. Over 60,000 Islanders were lured from their villages: tricked, transported, forced to work in the harsh Queensland bush, and then repatriated. Most Islanders returned with little savings to find their communities deeply scarred by the blackbirding trade and the internecine tribal conflict it had provoked.Georges Baudoux (1865-1949) was brought up amongst the Islanders who experienced the raw and competing greed of French, British and Australian colonialism. Son of a French prison commander stationed in New Caledonia, Baudoux lead a colourful life amongst the Pacific islands and deep in the brousse (bush) before becoming an author and capturing the stories of his travels and, importantly, the experiences of friends and colleagues as life in the islands changed forever. In recognition of his work, he was awarded the esteemed Palmes Académiques, the French medal for literary and academic achievement.Jean M'Barai is one of his best works. Expertly translated by Dr Karin Speedy and published here in English for the first time, this book exposes the rich, complex and brutal world of a South Sea Islander caught up in the duplicitous trade that came to be known as Blackbirding. It is an exciting, provocative and often astonishing account, drawing on the lived experience of people known to the author. In her critical introduction, Dr Speedy uncovers not just the author and his intriguing life (a life that spanned the uprising of the Paris communards in 1870 to post-Second World War reconstruction in the Pacific), but also the challenges for scholars working in, and undertaking translations in, the Francophone/Anglophone colonial/postcolonial sphere. Here, where empires, languages and Pacific peoples collide, the nuances of culture and terminology really matter if we are to find meaning amongst the shifting tides of use.Accompanied by photographs, postcards, cartoons and maps, this is a book to read and re-read, to contemplate ingenuity and inhumanity and the price all cultures pay as they are tested by forces beyond their control. It is a story that still resonates today, as we reflect on the experiences and resilience of the Pacific South Sea Islanders who contributed to modern Australia: the many that left and the descendants of those who stayed.

Abstract

Qhapaq Ñan, refers to a network of roads built during the time of the great inca empire. Almost 55,000 kilometers long this net of roads extended across the entire geographical area of the Inca. The Thesis, that guides this study, is that selected parts of the Qhapaq Ñan could be used for touristic use, presuming this tourism follows sustainable criteria. Not mass tourism but rather innovative programs with a concept that focuses on the balance between “use and protection” of these sensitive areas, will be essential., operated by the local communities could be the right way.

Abstract

South Australia is a small economy that faces a fundamental need to re-shape its approach to innovation. The manufacturing sector, as the backbone of the state’s economy, has and will continue to change in its nature and form. This necessitates a re-think about how innovation happens and how the respective actors within an economy interact and engage with each other. In effect, innovation relies on intersections between people, knowledge, information sharing, ideas, financial and other resources. Innovation happens through regional social and economic system dynamics; innovation relies on a system view of entrepreneurship. Entrepreneurship can be taken as a study of the entrepreneur and new business creation. However, this conception of entrepreneurship misses the critical link to economic outcomes; the ebb and flow of social and economic fortunes that are underpinned by the actions, reactions and engagement of individuals in a specific social and economic system that brings about innovation and change. In this book the authors are exploring how the linkages within the system can be conceptualised and made transparent.
