Abstract

Greg Burgess’s important new study explores the short life of the High Commission for Refugees (Jewish and Other) Coming from Germany, from its creation by the League of Nations in October 1933 to the resignation of High Commissioner, James G. McDonald, in December 1935. The book relates the history of the first stage of refugees from Germany through the prism of McDonald and the High Commission. It analyses the factors that shaped the Commission’s formation, the undertakings the Commission embarked upon and its eventual failure owing to external complications. The League of Nations and the Refugees from Nazi Germany argues that, in spite of the Commission’s failure, the refugees from Nazi Germany and the High Commission’s work mark a turn in conceptions of international humanitarian responsibilities when a state defies standards of proper behaviour towards its citizens.

Abstract

Europe is currently facing one of the biggest influx of refugees and displaced people since the end of the wars in the Balkans. At the same time, there has also been an increase in terroristic attacks in recent years. States seem to fear a correlation between these two developments, and refugees and asylum seekers are increasingly seen as risks to national security. This doctoral thesis contains a thorough analysis of those provisions of the EU Asylum Qualification Directive which aim to address these concerns, and allow for the exclusion of certain persons from international protection, the restriction of their status rights, or even the revocation or ending of protection. It argues that it is possible and imperative to uphold the standards of international refugee and human rights law even in the face of exacerbated security concerns of the Member States.

Abstract

This book is a philosophical analysis of the ethical treatment of refugees and stateless people, a group of people who, though extremely important politically, have been greatly under theorized philosophically. The limited philosophical discussion of refugees by philosophers focuses narrowly on the question of whether or not we, as members of Western states, have moral obligations to admit refugees into our countries. This book reframes this debate and shows why it is important to think ethically about people who will never be resettled and who live for prolonged periods outside of all political communities. Parekh shows why philosophers ought to be concerned with ethical norms that will help stateless people mitigate the harms of statelessness even while they remain formally excluded from states.
