Abstract

Minorities, indigenous peoples and local communities have their own status in public international law. Given their position within the politics of a societal majority, they require a certain protection and enjoy particular group rights. However, it is unclear how to legally determine such culturally distinct sub-state groups. Who is entitled to the international legal guarantees of minority protection, who holds the right to self-determination and who owns traditional knowledge? Up until now the politically motivated debates in research and practice circled unsuccessfully around different approaches of definitions and criteria of cultural difference. This thesis shows that it is the recognition as a ‘minority’, ‘indigenous people’ or ‘local community’, which becomes the constitutive act for the legal status of a group. In contrast to the politically driven debates about the scope of definitions, the perspective of recognition, as presented in this book, makes the relevant processes and institutions visible. The recognition of sub-state groups can be contextualized in public international law in relation to the principles of the recognition of states, while also being anchored by an interdisciplinary approach. The perspective of recognition replaces the discussion about general criterial definitions and allows an identification of the power imbalances and conflicts of interests, which are inherent to the question of the legal status of culturally distinct sub-state groups.

Abstract

Laypeople think of wake, sleep and dreaming as distinct states of the mind/brain but “in-between”, hybrid states are recognized. For example, day-dreaming or, more scientifically, the default network occurs during wake. Equally, during sleep, lucid dreaming in rapid eye movement (REM) sleep presents as another hybrid state. But hybrid states are usually temporary. This book explores the possibility of an enduring hybrid wake-sleep-dream state, proposing that such a state may engender both creativity and psychopathologies. REM sleep is hyper-associative. Creativity depends on making remote associations. If REM sleep and dreaming begin to suffuse the wake state, enhanced creativity may result. But moderate to severe interpenetration of wake, sleep and dreaming may engender psychopathologies – as the functions of wake, sleep and dreaming are partially eroded.

Abstract

This book presents an ethnographic study of how grassroots activism in Venezuela during the Chávez presidency can be understood in relation to the country's history as a petro-state. Taking the contested relationship between the popular sectors and the Venezuelan state as a point of departure, Iselin Åsedotter Strønen explores how notions such as class, race, state, bureaucracy, popular politics, capitalism, neoliberalism, consumption, oil wealth, and corruption gained salience in the Bolivarian process. A central argument is that the Bolivarian process was an attempt to challenge the practices, ideas, and values inherited from Venezuela's historical development as an oil-producing state. Drawing on rich ethnographic material from Caracas' shantytowns, state institutions, as well as everyday life and public culture, Strønen explores the complexities and challenges in fostering deep social and political change.

Abstract

"Internationally, the case of early modern Sweden is noteworthy because the state building process transformed a locally dispersed and sparsely populated area into a strongly centralized absolute monarchy and European empire at the beginning of the 17th century. This anthology provides fresh insights into the state-building process in Sweden. During this transitional period, many far-reaching administrative reforms were carried out, and the Swedish state developed into a prime example of the early modern ‘powerstate’. The contributors approach Sweden’s rise to greatness from the point of view of personal agency. In early modern studies, agency has long remained in the shadow of the study of structures and institutions. This novel approach enables us to expose the difficulties, setbacks and false steps that the administration had to deal with. State building was a more diversified and personalized process than has previously been assumed. Numerous individuals were also crucially important actors in the process, and that development itself was not straightforward progression at the macro-level but was intertwined with lower-level actors.&#xD;Each chapter in this volume employs partially different methods depending on the source material and subject. This means that both qualitative and quantitative material is combined, different ways of making sense of it (i.e. research traditions) are brought together and a multi-method design is used in analyzing source material. One of the central methods is the systematic use of previous biographical research. We want to give the individuals and their actions under discussion a background that reflects the contemporary structures of individual life cycles. With the existing biographical research, it is possible to create a comprehensive set of data that provides the general outlines of individual lives or the career tracks of various estates or social groups, and even to construct collective biographies of certain groups."

Abstract

Metallic corrosion is an expensive problem in industrialised countries, creating annual costs that are equivalent to around 3.5% of GDP. More than half of this amount is attributable to atmospheric corrosion. A large amount of scientific and technical literature has been published in the field of atmospheric corrosion, and numerous books and many general treatises have focused on this topic. In the period between 1970-2000 ASTM-STP made great efforts to disseminate progress in this field through the periodic publication of monographies and organisation of symposia on atmospheric corrosion. This special issue of Materials (MDPI) brings together the state of the art in this field, highlighting the advances made in the last fifteen years and identifying the areas where future research will need to concentrate. This publication is intended not only for researchers in the field of atmospheric corrosion, but also for technicians in charge of the design and maintenance of metallic items or concerned with their integrity and duration in the atmosphere.

Abstract

Cittadinanze offers a new perspective on the history of the State, understood in the aristotelian sense as the whole of its citizens. The volume contains twelve essays dedicated to the possible ways in which citizenship took shape during the contemporary age, analyzing the various historical concretions. Not a single, but a plural citizenship, an object and an epistemological instrument of many declinations - institutional, theoretical-political, juridical, philosophical. A reconstruction conducted through different places and times, ranging from the French and American revolutions to the immateriality of the digital divide. An original exam that interrogates the stories, practices and symbols that have linked individuals to their political communities.

Abstract

During the First World War, the parliaments of the states involved in the conflict were, in most cases, forced to drastically limit their activity and were often precluded the possibility of fully exercising their prerogatives. More generally the spaces of freedom granted to the citizens, of which the parliamentary institution was the brightest symbol, shrank dramatically. At the same time, the power of military commands expanded, not only in trenches and on battlefields, but also in many areas of civilian life. However, in the final years of the war, the Parliaments succeeded not only in gradually regaining control, but also in pushing for an extension of their functions, initiating a process that in many states coincided with the transition from a liberal order to a full democratic order. The years of the "long" postwar period were however dense with contradictions. Legislative and executive law often grew together, while in some cases the imperative logic imposed for a long time in wartime re-emerged and consolidated. This volume, which examines several national cases, illustrates some of the ambivalent features of this dramatic phase of European history.

Abstract

Born in 1883 – the same year that ‘Thus Spoke Zarathustra’ was published and German composer, Richard Wagner, passed away –, journalist and diplomat, Augusto de Castro, would come across ‘delightful ironies’ in life, as he claimed later on. Thus, while Zarathustra belonged to one of Benito Mussolini’s favourite authors – an Italian dictator, also born in 1883, openly admired by Castro throughout the first decades of the 20th century –, the disappearance of Parsifal’s creator set the theme for one of the most nostalgic articles written by Augusto de Castro, which provided the title to his second-last work, ‘Eighty-three years ago in Venice’ (1966). This book suggests a journey through the life and works of Augusto de Castro, a larger-than-life character of 20th-century diplomacy, politics, and culture, who closely followed the main changes that took place in this country, and communed with the main political, economic, and cultural actors of the national and international scene of the time.

Abstract

This work contributes to a better characterization, in forensic perspective, of the assessment of post-traumatic bodily injury when a prior state is present and promotes the uniformity increasing of the assessment carried out by professionals on the concepts analyzed. Will be addressed the possible associations between organic or traumatic pathologies and a previous state, in arder to better describe the general and specific principies for the establishment .of imputability and/or aggravation of those pathologic conditions. In that regard, will be narrated medicolegal expertise where traumatic injuries caused any further deterioration of the previous state or that this negatively influenced the trauma consequences. Such cases were analyzed, emphasizing the methodology of forensic evaluation and the form of appreciation of the prior state. The aim is to also understand what the effect of forensic conclusion in the court ruling, which concludes this work with an analysis of value or influence of forensic assessment in taking judicial decision in Portugal when a pre-existing pathological condition was present, identifying the strengths and weaknesses of it.
