Ce manuel d'histoire des institutions présente deux particularités : Il prétend d'abord effacer la frontière classique entre les matières relevant du droit public (organisation de l'État et de l'administration) et celles qui tiennent au droit privé (famille, travail, propriété). Séparation dont la critique est passée en lieu commun, mais qui, dans les ouvrages rédigés à l'usage des étudiants en droit, est encore et toujours strictement maintenue. La formule du mémento a été délibérément écartée. Pas question pour nous d'accabler la mémoire du lecteur, de l'égarer dans la broussaille des détails, de multiplier les énumérations sans substance et sans interprétation. Les faits, les événements, les institutions, les dates viennent simplement à l'appui d'une démonstration : celle qui consiste à mettre en évidence la poussée au cours de ces deux siècles (1750-1945) d'une démocratie à la fois raisonnable et exigeante, opposée à l'hydre constamment renaissante de l'oligarchie, lutte éternelle qui est de l'essence même de la politique.

Abstract

This open access book about the Zadeh Project demonstrates and explores a core question in clinical ethics: how can ethics consultants be accountable in the face of a robust plurality of ethical standpoints, especially those that underwrite practices and methods for doing ethics consultation as well as those viewpoints and values encountered in daily clinical ethics practice? Underscoring this question is the recognition that the field of clinical ethics consultation has arrived at a crucial point in its maturation. Many efforts are underway to more formally “professionalize” the field, with most aimed toward stabilizing a specific set of institutional considerations. Stretched between these institutional and practical initiatives resides a crucial set of of ethical considerations, chief among them the meaning and scope of responsibility for clinical ethics consultants. Developed around a long-form case scenario, the Zadeh Project provides a multi-layered series of “peer-reviews”: critique of the actions of the case scenario’s ethics consultant; reflection on clinical ethics method; examination of the many ways that commitments to method and practice can, and do, intersect, overlap, and alter one another. The design and format of this book thus models a key element for clinical ethics practice: the need and ability to provide careful and thoughtful explanation of core moral considerations that emerge among diverse standpoints. Specifically designed for those studying to become and those who are ethics consultants, this book, with its innovative and multi-layered approach, allows readers to share a peer-review-like experience that shows accountability to be what it is, an ethical, not merely procedural or administrative, undertaking.

Abstract

Au sein de l’ensemble des territoires contrôlés par les dynasties angevines, nous proposons d’examiner le personnel chargé des services centraux, la chancellerie, les cours de justice, les Chambre des comptes et archives, ou encore le conseil royal ou l’hôtel, tout comme les officiers des cours locales. On s’interrogera sur l’origine, la formation, les réseaux et les carrières de ce personnel, ainsi que sur la genèse institutionnelle de ses offices et charges. Tous ces éléments de départ s’articuleront avec une réflexion sur l’émergence de cultures administratives et politiques propres à ce groupe, autant de valeurs, de normes sociales, de pratiques, de dévotions et de goûts spécifiques caractérisant la genèse d’un milieu, et dans certains cas d’un « corps de l’État », dans le prolongement du colloque précédent tenu à Angers en novembre 2015 (« Parcours universitaires et formations intellectuelles des officiers angevins »). La question des circulations, des modèles et des échanges est certes importante. Mais dans un contexte monarchique, l’enjeu est aussi d’interroger précisément les phénomènes de « dépersonnalisation » de l’État et de discuter cette notion au regard de l’élaboration d’une « machine administrante » distincte de la personne du souverain et dont ce milieu est l’acteur. Pour éclairer ces processus, il s’agira de recourir tant à la prosopographie qu’aux carrières individuelles, à l’archéologie, à l’histoire et à l’histoire de l’art, à l’histoire des idées et des croyances, tant aux usages de l’écrit administratif ou spéculatif, qu’aux arts et lettres.

Abstract

The author of this innovative study argues that key politicians and their policy ideas, through "ideational leadership", have played an important role in the passing of structural reforms in the change-resistant German welfare state. This argument is based on in-depth case studies of individual reforms in health care, pensions and unemployment insurance since the early 1990s as well as a concise analysis of recent changes in family policy. Stiller concludes that Germany, traditionally a Bismarckian welfare state, has embarked on a path of 'hybridisation' that confronts German politics with growing societal divisions. This thought-provoking title is highly recommended for policymakers, scholars and students interested in the past and future reforms of the German welfare state, leadership, and the role of ideas in policymaking.

Abstract

Making illegal residence unattractive is a way for Western governments to limit migration from non-Western countries. Focusing on Dutch neighbourhoods with substantial levels of unauthorised migrants, Illegal Residence and Public Safety in the Netherlands examines how restrictive immigration policy influences immigrant crime and perceived neighborhood security. Salient questions arise. To what extent, and under which conditions, do illegal residence and illegal migration impact public safety? Does having illegal residence status influence how people observe or break the law and other social rules? Do their ties with established groups, such as legal migrants, employers and partners, have any sway? Answers to these issues begin surfacing in this rich combination of quantitative information, comprising police figures and surveys on victimisation, and qualitative sources, including interviews at the Dutch Aliens Custody and urban field research.

Abstract

In the last decade, there has been a distinct trend towards a worldwide harmonisation of migration statistics, chiefly pushed by international bodies and organisations that need comparative data. Statistics and Reality shows that these attempts have as yet not been very successful. It provides an accessible account of the history of migration measurement in Europe and analyses the current conceptualisations of migration and data gathering procedures in twelve European countries in the context of their migration histories. Based on this analysis, the authors provide a critical insight into the migrant stocks and flows in their countries.

Abstract

This book examines two major social changes experienced by European cities in the last two decades: post-industrial economic restructuring and new immigration flows. The link between both has been extensively discussed throughout a variety of theoretical approaches and in numerous descriptive contributions. Adding to those studies, this research focuses on three elements of migratory experience that have been relatively neglected thus far: a dynamic view of changes over time, the influence of national welfare and legislation frameworks, and the importance of support mechanisms outside the labour market. The material underpinning the arguments is the qualitative life-course analysis of 81 in-depth interviews with Senegambian migrants living in Antwerp and Barcelona.

Abstract

This meticulously researched study of irregular migrant work in Austria holds many broader lessons for countries all over Europe. The book derives many of its fascinating insights from systematic in-depth interviews with migrants themselves. The authors demonstrate that it is no longer enough to divide the world of foreign employment into "legal" and "illegal" work. Instead, over the past few years, particularly in the context of progressive EU-enlargement in Europe, new manifestations of "irregular migrant work" have evolved. Moreover, the authors convincingly argue that irregular migrant work is based on both supply and demand, and is therefore unlikely to fade away in the foreseeable future.
