Abstract

En este libro presentamos los aportes realizados por Profesores y Docentes que han ofrecido módulos temáticos o clases magistrales en la Cuarta Escuela de Verano llevada a cabo por el Centro de Estudios de Derecho Penal y Procesal Penal Latinoamericano (CEDPAL) de la Georg-August-Universität Göttingen. Los textos acá compilados dan cuenta de ámbitos temáticos relativos a la dogmática penal, el derecho penal comparado, la política criminal, el derecho procesal penal y la justicia penal europea. Se trata de contribuciones sin precedentes sobre las ciencias criminales en Alemania y desde el espectro jurídico comparado a nivel europeo, anglosajón y latinoamericano. Adicionalmente, se pone a disposición del lector un relevante trabajo dedicado a la complicidad en el asesinato por medio del servicio en el campo de concentración de Auschwitz. En el mismo se presenta por primera vez en lengua castellana la sentencia del Tribunal Supremo Federal alemán sobre el caso Gröning (Decisión del 20 de septiembre de 2016 - 3 StR 49/16) junto al comentario realizado por el Profesor Claus Roxin a dicha sentencia. Tanto la compilación presentada, como la estructura a partir de la cual se desarrolla la misma, reflejan de forma certera el espíritu de la Escuela de Verano, pensada tanto para difundir el estado actual de las ciencias criminales alemanas, como para construir un puente de intercambio y apertura académica con juristas hispanohablantes y lusófonos.

Abstract

This innovative study regards National Socialist criminal law—in accordance with the theories of continuity and radicalisation—as the racist (anti-Semitic), nationalistic (Germanic) and totalitarian updating of the authoritarian and anti-liberal tendencies found in German criminal law at the turn of the 20th century and during the Weimar Republic. The author proves this thesis through systematic analysis of the works of relevant authors, focusing primarily on the texts, which speak for themselves, rather than on morally judging the people who wrote them. In doing so, he also examines the reception of German (National Socialist) criminal law in Latin America. The aforementioned continuity did not only exist from a past perspective (post-Weimar), but also from a forward-looking perspective (‘the Bonn Republic’ 1949–1990). In short, neither did National Socialist criminal law appear from nowhere, nor did it completely disappear after 1945, which has seamlessly led to the modern-day attempt to reconstruct the identity of this Germanic myth through the so-called ‘neue Rechte’ or ‘New Right’ political movement.

Abstract

This book contains some of the papers that were presented at the first meeting of the newly formed African Expert Study Group on International Criminal Law / Groupe des Experts Africaines en Droit Pénal International held in September 2011 in Brussels, Belgium. The group was established under the auspices of the Multinational Development Policy Dialogue (hereinafter ‘MDPD’) and the Rule of Law programme of the German Konrad-Adenauer-Stiftung (‘KAS’) in 2010 modeled on the successful sister group in Latin America. This latter group was originally founded as an expert group to monitor the implementation of the Rome Statute of the International Criminal Court (‘ICC’) in Latin America within the framework of cooperation between KAS’ regional Rule of Law Programme and the Department for Foreign and International Law of the Institute for Criminal Law and Criminal Justice of the Georg-August-Universität Göttingen in 2002. The newly formed African group consists of judicial experts with both academic and practical background from various parts of Sub-Saharan Africa. The importance of such a group for the African continent cannot be overestimated. Africa plays a vital role in international criminal law and justice, both as an active player at the ICC and at the regional and national level. As for the group’s composition and outreach, the aim is to broaden regional representation and further consolidate membership. In 2012, the group will meet in Nairobi, Kenya to deal with topics surrounding the ‘Potential for the domestic prosecution of international crimes in Africa.’ Topics for future meetings abound given the multi-faceted African legal and political practice regarding international criminal justice in general and the ICC in particular. The group should in particular monitor the recent international or transnational criminal justice developments at the regional African level as well as relevant national developments. Abstract

En este libro presentamos los textos cuya autoría pertenece a quienes han ofrecido módulos temáticos o clases magistrales en la Segunda y en la Tercera Escuela de Verano desarrollada por el Centro de Estudios de Derecho Penal y Procesal Penal Latinoamericano (CEDPAL) de la Georg-August-Universität Göttingen. Los aportes se han agrupado de acuerdo a dos únicas categorías: En la primera parte, titulada Ciencias criminales en y desde Alemania, se ubican textos escritos desde la teoría, normativa y jurisprudencia alemanas, dedicados específicamente a problemáticas de este contexto. En la segunda parte, denominada Ciencias criminales: diálogos entre Alemania y el resto del mundo, se agrupan aquellos trabajos en los que las ciencias criminales si bien son trabajadas desde el contexto alemán tienen por objeto las interrelaciones culturales e internacionales y el diálogo entre distintas tradiciones jurídico-penales. Finalmente, se destacan dos breves homenajes dedicados a los Profesores Winfried Hassemer y Horst Schüler-Springorum. Tanto la compilación presentada, como la estructura a partir de la cual se desarrolla la misma, reflejan de forma certera el espíritu de la Escuela de Verano, pensada tanto para difundir el estado actual de las ciencias criminales alemanas, como para construir un puente de intercambio y apertura académica con juristas hispano- y lusoparlantes.
