Abstract

To summarise our findings, the Hippocratic Epidemics case reports is an example of a text whose intended audiences, despite the ambiguities and historical uncertainties about the texts’ composition and transmission, were very firmly delimited as professional and medical. Such closure defines this phase of ancient medicine as particularly territorial and “technical”, on the one hand – no literary pretence, nor broader intellectual appeal of the kind shown by Galen is on the horizon of these writers, nor any explicit attempt to win over lay audiences, at least in the Epidemics.77 Also, it tells us something about the epistemology and didactics at work in the Hippocratic handling of patients, which we can summarise as follows: non-theoretical, observation-based and data-centred; self-standing, i.e. not relying on a system of knowledge or a “syllabus” (compare Galen’s frequent recommendation on which of his books one should read first, which are for beginners, what should follow, etc.), but needing to “support itself” by insuring the memorisation of the repertoires of observations, procedures, risks and mistakes; lack of a synthesis of the empirical data, such as a form of diagnosis, or of the “epistemological extension” that might turn the observed case into an “experiment”.78 The Hippocratic use of individual evidence – the patient case – remained in this early stage a communication of pure data. Individual memory, in conclusion, the reception of an individual intellect – a future student, a training doctor – characterises the audience of these texts, motivates and even determines, concretely, their very existence.

Abstract

This book takes a unique approach to explore the moral foundations of nationalism. Drawing on nationalist writings and examining almost 200 years of nationalism in Ireland and Quebec, the author develops a theory of nationalism based on its role in representation. The study of nationalism has tended towards the construction of dichotomies – arguing, for example, that there are political and cultural, or civic and ethnic, versions of the phenomenon. However, as an object of moral scrutiny this bifurcation makes nationalism difficult to work with. The author draws on primary sources to see how nationalists themselves argued for their cause and examines almost two hundred years of nationalism in two well-known cases, Ireland and Quebec. The author identifies which themes, if any, are common across the various forms that nationalism can take and then goes on to develop a theory of nationalism based on its role in representation. This representation-based approach provides both a basis for the moral claim of nationalism while at the same time identifying grounds on which this claim can be evaluated and limited. It will be of strong interest to political theorists, especially those working on nationalism, multiculturalism and minority rights. The special focus in the book on the Irish and Quebec cases also makes it relevant reading for specialists in these fields as well as for other area studies where nationalism is an issue.

Abstract

This short monograph attempts an exploration of the legal treatment of evidence questions in Cyprus law. The first section of the study offers a comparative-law introduction to the legal system of Cyprus – a mixed legal system that in matters of civil litigation, including evidence, tends to strongly follow the English common law tradition (including the existence of an autonomous legal field of evidence law, that tends to be dominated by criminal evidence law. The second section presents the general principles underlying Cypriot civil procedure, including evidence. The sections that follow examine in more detail legal aspects involving civil evidence, especially how the basic types of evidence are treated in Cyprus law and how the processes for the taking of evidence are organized. The study also examines special questions including the legal treatment of illegally obtained evidence, legal costs and problems of language. The final section examines the cross-border dimensions of civil evidence-taking.

Abstract

After a brief historical introduction, the short monograph reviews the system of evidence in Hungarian civil proceedings, approaching the topic from the aspect of the basic principles. Following changes in the role of material truth, it presents alterations in the interpretation of and re-interpretation of the notion of the principle of free disposition of the parties. Then it deals with the following basic principles and their relation to evidence: principle of orality, principle of directness, principle of public hearing, principle of equality of arms, right to be heard, ensuring the use of one’s mother tongue, principle of procedural economy, the proper (bona fide) conduct of the lawsuit, principle of adversarial hearing, principle of the freedom of proof. After examining the questions of admissibility of evidence and burden of proof, it discusses particular means of evidence, the taking of evidence, the preliminary taking of evidence, costs of evidence, the question of unlawful evidence, and finally, the cross-border taking of evidence.

Abstract

This book contributes to the empirical literature on households’ participation in microfinancial services in developing countries. First, it estimates simultaneously the participation in microinsurance schemes and other financial services on household survey data from Ghana. Second, it analyzes the household’s cumulative participation in microfinancial services using household survey data from Sri Lanka. Next, the study focuses on the question whether household’s participation in micro life insurance in Sri Lanka is motivated by the desire to leave bequests. At last, it investigates different sequential steps of the household’s microinsurance participation decision and the joint analysis of micro life and health insurance enrolment in Sri Lanka.

Abstract

Cultural expertise in the form of expert opinions formulated by social scientists appointed as experts in the legal process is not different from any other kind of expertise in court. In specialised fields of law, such as native land titles in America and in Australia, the appointment of social scientists as experts in court is a consolidated practice. This Special Issue focuses on the contemporary evolution and variation of cultural expertise as an emergent concept providing a conceptual umbrella for a variety of evolving practices, which all include use of the specialised knowledge of social sciences for the resolution of conflicts. It surveys the application of cultural expertise in the legal process with an unprecedented span of fields ranging from criminology and ethnopsychiatry to the recognition of the rights of autochthone minorities including linguistic expertise, and modern reformulation of cultural rights. In this Special Issue, the emphasis is on the development and change of culture-related expert witnessing over recent times, culture-related adjudication, and resolution of disputes, criminal litigation, and other kinds of court and out-of-court procedures. This Special Issue offers descriptions of judicial practices involving experts in local laws and customs and surveys of the most frequent fields of expert witnessing that are related with culture; interrogates who the experts are, their links with local communities, and also with the courts and the state power and politics; how cultural expert witnessing has been received by judges; how cultural expertise has developed across the sister disciplines of history and psychiatry; and eventually, it asks whether academic truth and legal truth are commensurable across time and space.
