Abstract

The commercialisation of sport in Europe raises important questions concerning the most appropriate method of regulating sporting activity. The development of the European Union and the internationalisation of sporting competition has added an international dimension to this debate. Yet sport is not simply a business to be regulated in the same way as any other industry. It is also a social and cultural activity. Can regulation at EU level reconcile this tension? Adopting a distinctive legal and political analysis, this book argues that the EU is receptive to the sports sectors claims for special treatment before the law. Abstract

Abstract

This book reviews a variety of approaches to the study of the European Union's foreign policy. Much analysis of EU foreign policy contains implicit theoretical assumptions about the nature of the EU and its member states, their inter-relationships, the international system in which they operate and the nature and direction of European integration. In many instances such assumptions - not being discussed openly - limit, rather than facilitate debate. The purpose of this book is to open up this field of enquiry so that students, observers and analysts of EU foreign policy can review a broad range of tools and theoretical templates from which the development and the trajectory of the EU's foreign policy can be studied. Situated as it is at the interface between European Studies and International Relations, the book also seeks to engage the attention of readers who are anxious to understand how the European Union relates to the rest of the world and to explain the efforts of the EU and its member states towards the creation of a credible, effective and principled foreign, security and defence policy.

Abstract

It is increasingly recognised that EU development cooperation policy has failed to meet its stated aims. In this book Arts and Dickson ask the obvious and important question: if the policy doesn't work, why bother with it? The authors assess why EU development policy has become largely ineffective, citing among the external causal factors the liberalisation of trade, and the growing influence of US and international actors such as the World Bank and the International Monetary Fund upon EU policy. It also considers contributing factors within the EU such as the enlargement of its membership and the resulting shifts in priorities. It is this analysis of internal and external factors affecting the decline of EU development policy that makes this study both innovative and unique. Abstract

Examining the legal effects of EU concluded treaties, this book provides an analysis of this increasingly important and rapidly growing area of EU law. The EU has concluded more than 1,000 treaties including recently its first human rights treaty (the UN Rights of Persons with Disability Convention). These agreements are regularly invoked in litigation in the Courts of the member states and before the EU courts in Luxembourg but their ramifications for the EU legal order and that of the member states remains underexplored. Through analysis of over 300 cases, the book finds evidence of a twin-track approach whereby the Court of Justice of the European Union (CJEU) adopts a maximalist approach to Treaty enforcement, where EU agreements are invoked in challenges to member state level action whilst largely insulating EU action from meaningful review vis-à-vis agreements. The book also reveals novel findings regarding the use of EU agreements in EU level litigation including: the types and which specific EU agreements (including the types of provisions) have arisen in litigation; the nature of the proceedings (preliminary rulings or direct actions) and the number of occasions in which they have been addressed in challenges to member state or EU action and the outcomes; who has been litigating (individuals, institutions, or member states) and which domestic courts have been referring questions to the CJEU. The significance of the judicial developments in this area are situated within the context of the domestic constitutional ramifications for member state legal orders thus revealing a neglected dimension in the constitutionalization debates, which traditionally emphasized the ramifications of internal EU law for the domestic constitutional order without expressly accommodating the constitutional significance of this external category of EU law nor the different challenges that this poses domestically.

Abstract

The European Union interest group population is often characterised as being&#xD;biased towards business and detached from its constituency base. Many scholars&#xD;attribute this to institutional factors unique to the EU. Yet, assessing whether or&#xD;not the EU is indeed unique in this regard requires a comparative research design.&#xD;We compare the EU interest group population with those in four member states:&#xD;France, Great Britain, Germany and the Netherlands. We diff erentiate system, policy&#xD;domain and organisational factors and examine their eff ects on interest group&#xD;diversity. Our results show that the EU interest system is not more biased towards&#xD;the representation of business interests than the other systems. Moreover, EU&#xD;interest organisations are not more detached from their constituents than those in&#xD;the studied countries. Everywhere, business interest associations seem to be better&#xD;capable of representing their members’ interests than civil society groups. These&#xD;fi ndings suggest that the EU is less of a sui generis system than commonly assumed&#xD;and imply the need for more fi ne-grained analyses of interest group diversity.

Abstract

How has the international mobility of Polish citizens intertwined with other influences to shape society, culture, politics and economics in contemporary Poland?&#xD;&#xD;The Impact of Migration on Poland offers a new approach for understanding how migration affects sending countries, and provides a wide-ranging analysis of how Poland has changed, and continues to change, since EU accession in 2004. The authors explore an array of social trends and their causes before using in-depth interview data to illustrate how migration contributes to those causes. They address fundamental questions about whether and how Polish society is becoming more equal and more cosmopolitan, arguing that for particular segments of society migration does make a difference, and can be seen as both leveller and eye-opener. While the book focuses mainly on stayers in Poland, and their multiple contacts with Poles in other countries, Chapter 9 analyses ‘Polish society abroad’, a more accurate concept than ‘community’ in countries like the UK, and Chapter 10 considers impacts of immigration to Poland.&#xD;&#xD;The book is written in a lively and accessible style, and will be important reading for anyone interested in the influence of migration on society, as well as students and scholars researching EU mobility, migration theory and methodology, and issues facing contemporary Europe.&#xD;

Abstract

This chapter differs from others in this monograph in its focus on two political&#xD;organisations, the EU and the COE, and their top-down&#xD;efforts to engage with&#xD;issues of heritage and identity. These organisations represent the two most&#xD;visible post-1945&#xD;political efforts to transform Europe as a region, by promoting&#xD;further integration; both are driven by a fluid collective memory of the impact&#xD;made by world wars, genocide, economic deprivation and other forms of societal&#xD;disruption. By their very nature, both organisations have sought to engage with&#xD;the construction and reconstruction of history and identity, both to pursue a&#xD;vision of a common Europe and to build a sense of purpose and value in their&#xD;organisational efforts to build integration (and therefore justify their existence).&#xD;They have selected particular policy instruments, which Hood (1983) defines as&#xD;the tools by which actors implement their governance strategies. The core&#xD;research question is: how do these two institutions seek to intervene and make&#xD;people engage with memories, histories and identities by creating cultural heritage&#xD;institutions and instruments?
