Abstract

By examining the implementation dynamics of EU Readmission Agreements (EURAs), this book addresses the practical reasons why irregular immigrants cannot be expelled. EURAs are one of the vital legal instruments framing EU external migration law with regard to the expulsion of irregular immigrants, yet their implementation has met with various obstacles. Above all, the process of determining an individual’s legal identity has proven to be one of the most controversial aspects in the implementation of EURAs.The analysis shows that the process of identifying who is whose national in the context of readmission creates two existential dilemmas: first from the perspective of the sovereignty of third countries of origin and the legal standards laid out in international instruments as regards states’ powers in determining nationality, and second regarding the agency of the individual as a holder of fundamental human rights.How do the EURAs deal with or aim at alleviating these identity determination dilemmas? The book provides a comparative analysis of the administrative procedures and rules envisaged by EURAs aimed at proving or presuming the nationality of the persons to be readmitted to their country of origin. It focuses on the ways in which nationality is to be determined or presumed in the scope of the 2010 EURA with Pakistan, and compares it with those foreseen in the EURAs with Armenia, Azerbaijan, Cape Verde, Georgia, and Turkey. As such, the book provides a unique and up-to-date study of EURAs and their implementation challenges in the broader context of EU external migration law and policy.

Abstract

The book is a cornerstone in the studies aimed at introducing a new form of democracy not just at a global level, through international environmental law, but also at local one, by regional and national regulation, to manage global and local ecological problems. In the light of the results pointed out in Parola's book (Environmental democracy at Global Level. Rights and duties for a new citizenship), this second work examines environmental democracy at a local level by referring to EU law. The European Union, as the only global region with the official objective of simultaneously promoting economic development, social cohesion and environmental protection is here used as an example for analyzing how the region has found (and is still developing) a range of solutions to various environmental issues. The book sheds new light on the transformation of Europe into a Green Europe.

Abstract

In Urban Europe, urban researchers and practitioners based in Amsterdam tell the story of the European city, sharing their knowledge of and insights into urban dynamics in short, thought-provoking pieces. Their essays were collected on the occasion of the adoption of the Pact of Amsterdam with an Urban Agenda for the European Union during the Dutch Presidency of the Council in 2016. Abstract

This book investigates European citizenship after Brexit, in light of the functionalist theory of citizenship. No matter its shape, Brexit will impact significantly on what has been labelled as one of the major achievements of EU integration: Citizenship of the Union. For the first time an automatic and collective lapse of status is observed. It is a form of involuntary loss of citizenship en masse, imposed by the automatic workings of the law on EU citizens of exclusively British nationality. It does not however create statelessness and it is likely to be tolerated under international law. This loss of citizenship is connected to a reduction of rights, affecting not solely the former Union citizens but also second country nationals in the United Kingdom and their family members.The status of European citizenship and connected rights are first presented. Chapter Two focuses on the legal uncertainty that afflicts second country nationals in the United Kingdom as well as British citizens, turning from expats to post-European third country nationals. Chapter Three describes the functionalist theory and delineates three ways in which it applies to Brexit. These three directions of inquiry are developed in the following chapters. Chapter Four focuses on the intension of Union citizenship: Which rights can be frozen? Chapter Five determines the extension of Union citizenship: Who gets to withdraw the status? The key finding is that while Member states are in principle free to revoke the status of Union citizen, former Member states are not unbounded in stripping Union citizens of their acquired territorial rights. Conclusions are drawn and policy-suggestions summed up in the final chapter.

Abstract

Do EU citizens have real opportunities to hold decision-makers accountable, or does the current institutional set-up in the Union merely create an illusion of accountability? That is the central question of this volume. There are widespread and growing concerns that the political system of the EU does not, in fact, afford citizens appropriate mechanisms of accountability. The aim of the current study is to ascertain whether such concerns are warranted.

Abstract

If we look at the contemporary academic discourse of political studies in gen- eral and the scholarship on international relations in particular, we notice that many analysts start on the basis that there is something ‘new’ about the world: that it is a “brave new world”1 we are living in, that we are facing ‘new’ challenges and problems and threats, and that ‘new’ solutions are needed. Starting on this premise, much of the scholarship in political studies and international relations is then about the study of this ‘new’ world and the search for ‘new’ solutions that could address and deal with the perceived ‘new’ challenges we are said to be facing

Abstract

The book analyses the attitudes of non-EU countries towards European integration in historical and contemporary perspectives. The authors study a range of actors in Europe and beyond to explain the impact of the creation of the European Communities on the international system and how the EU is perceived in the world. The book further shows the significance of the institutional interplay within the EU, and between EU institutions, member states and external actors led by their own internal dynamics to explain policy outcomes. It investigates to what extent the perceptions of the international community towards the European Communities and the EU have been influenced by the complexity of their decision-making and the difficulty of reconciling the views of member states on key external relations issues. The authors also study the interplay of non-EU countries and the EU within the broader context of international and regional institutions and forums for international cooperation.
