Abstract

Wissenschaft meint seit jeher nicht nur theoretische Reflexion, sondern immer auch gesellschaftliche Praxis. Heute steht diese Praxis, die Welt der modernen Wissenschaften und ihrer institutionellen Formen mitten im Strom tiefgreifender Veränderungen – Exzellenzinitiativen und Clusterbildung, Studiengebührenfinanzierung und Bologna-Prozess, Wettbewerbsstrukturen, Globalhaushalte und externe Management-Maßstäbe sind hierfür nur einige illustrierende Schlagworte. Den Handlungsdrang der deutschen Hochschulpolitik im Blick gerät naturgemäß auch das Wissenschaftsrecht in Bewegung. Fragen seiner verfassungsrechtlichen Grundierung und seiner verwaltungsrechtlichen Feinzeichnung sind so umstritten wie lange nicht. Das Leitmotiv, ob das heutige Wissenschaftsrecht in erster Linie dem Schutz der individuellen Forschungsleistungen einzelner Wissenschaftlerinnen und Wissenschaftler dient oder ein Baukasten zur Modernisierung der Hochschulen ist, führt wiederkehrend zu den Grundfragen des modernen Öffentlichen Rechts. Diese Entwicklungen vor Augen beging das Institut für Öffentliches Recht an der Juristischen Fakultät der Georg-August-Universität Göttingen seine Neugründung mit einer Arbeitstagung zum Thema „Aktuelle Probleme des Wissenschaftsrechts“. Die Beiträge der Tagung enthält dieser Band. Er ist der erste einer neuen Schriftenreihe zum Öffentlichen Recht.

Abstract

Australia lacks a scholarly book that covers recent developments in public sector governance in Australia and blends cross-disciplinary perspectives from law, management, public administration and public policy. The primary reason for writing this book is to fill the gap in the treatment of this subject, and to provide insights from empirical evidence and current practice. The book provides the first comprehensive theoretical and empirical work on governance in the Commonwealth public sector. It addresses the issues that emerged under the Howard government as well as their handling under the Rudd and Gillard governments. The book aims to enhance understanding of and communication about public governance across government, industry and the community.&#xD;&#xD;The authors bring to this book expertise gained from political science, public administration and policy, public and private sector law.

Abstract

In this evidence-based and closely argued work, Kathy MacDermott plots the changes in the culture of the Australian Public Service that have led many contemporary commentators to lament the purported loss of traditional public service values of impartiality, intellectual rigour and — most importantly — the willingness of public servants at all levels to offer frank and fearless advice to their superiors and their ministers. MacDermott brings to her analysis an insider’s sensibility and a thorough forensic analysis of the impact of some 20 years of relentless administrative ‘reform’ on the values and behaviour of the APS. Although this story has its beginnings in the Hawke-Keating eras, MacDermott convincingly argues that structural and cultural change compromising the integrity of the public service reached its apogee towards the end of the eleven years of the Howard government. This is a ‘must read’ for students of Australian political and administrative history. MacDermott offers cautionary observations that the new national government might do well to heed.

Abstract

The International Council for the Exploration of the Sea (ICES) is the central scientific network within the massive set of bureaucracies that is responsible for Europe's Common Fisheries Policy (CFP). While spending the past 25 years failing to sustain Europe's fish stocks, this management system also became adept at making the lives of its scientists miserable. Now it is being confronted by the complex challenge of an ecosystem-based approach to fisheries management. If this combination of a multi-national bureaucracy, hard politics, and scientific uncertainty has made it impossible to maintain many individual fish stocks, how are decisions going to be made that consider everything from sea birds to climate change? The old political saw that "if you can't solve a problem, make it bigger" has never been put to a test like this! Yet ICES has begun to rise in an impressive way to the scientific challenge of providing advice for an ecosystem approach within the world's most cumbersome fisheries management system. This book lays out the results of extensive sociological research on ICES and the decision making systems into which it feeds. ICES is finding ways to provide effective advice in the many situations where scientific advice is needed but a clear, simple answer is out of reach. In spite of the difficulties, scientists are beginning to help the various parties concerned with management to deal with facts about nature in ways that are more useful and transparent.

Abstract

Predictable and unpredictable challenges continually confront the policy settings and policy frameworks of governments. They provide a constantly changing dynamic within which policy-making operates. Governments at all levels are asking their public services to identify innovative and workable reforms to anticipate and address these challenges. Public service leaders around the world are struggling not only to better anticipate emerging demands but also to address reform backlogs. However, time and time again, major policy reforms can prove tough to implement – especially in turbulent environments – and even tougher to anchor over time. This leads to considerable uncertainty and inefficiency as governments and policy communities try to keep pace with change. Policies that unravel or are dismantled are costly and represent wasted opportunities. Abstract

This book is a roadmap of the exact health disparities that burden the health of South Texas residents, especially Hispanics, compared to the rest of Texas and nation. This type of knowledge has the potential to fuel and motivate researchers and public health leaders to create and shape interventions to reverse those health disparities. Most notably, focus on obesity and diabetes prevention efforts and modifiable risk factors—such as nutrition, reproductive factors and access to health care—has significant potential to reduce the burden of disease in South Texas communities.South Texas, a 38-county region that spans 45,000 square miles along the Texas-Mexico border northward to the area around metropolitan Bexar County (home to San Antonio), is home to 18% of the state’s population. Yet South Texas residents, who are 68% Hispanic, struggle with lower educational levels, less income and less access to health care—and, as a result, suffer from a wide variety of health disparities. To study the health status and identify the exact health disparities that exist in the region, researchers from The UT Health Science Center at San Antonio teamed with researchers from the Texas Department of State Health Services to develop the South Texas Health Status Review.The Review team analyzed a variety of the latest county, state and national data to compare South Texas’ incidence, prevalence and mortality rates for more than 35 health indicators—from cancers to chronic diseases like diabetes to communicable diseases like HIV/AIDS to maternal health and even environmental health—to the rest of Texas and the nation by age, sex, race/ethnicity and rural/urban location.​

Abstract

This book examines the roles, responsibilities and accountabilities of Australian cabinet ministers. It examines the sorts of jobs ministers do, what is expected of them, what they expect of the job and how they (are supposed to) work together as a team. It considers aspects of how they are chosen to become ministers; how they are scrutinised by parliament and the media; and how ministers themselves view accountability. It also looks at the causes of calls for ministers to resign, examines scandals around ministers and assesses ministerial accountability.
