Abstract

"International social law is often considered a technocratic matter only certain experts of welfare state administration and judicature have to deal with. This study argues to the contrary that the international coordination of social security systems expresses membership statuses to state entities. By analysing the political functionality of nationalisation and transnationalisation of social rights, it becomes evident that membership in welfare states is constructed by sovereign and economic rationalities. The latter serve as door-openers for national welfare states.Taking juridical and socio-philosophical concepts of membership of individuals in state entities as a starting point, the study analyses the legal history of ex- and inclusion of Polish workers in German social insurance from the late German Kaiserreich until the end of WWII using archival sources. It concludes by applying the findings to the debate on social human rights."

It explains the numerous measures taken in favour of disabled veterans and war widows during the war and in the post-war period and describes the powerful organisations of the invalids. The assistance for war victims expressed very early social policy as supported by the state.

Abstract

Die Zunahme des internationalen Handels und der internationalen Kapitalbewegungen wird oft für einen Abbau sozialstaatlicher Umverteilung verantwortlich gemacht. In dieser Arbeit wird die Frage untersucht, ob die wachsende Internationalisierung der Wirtschaft zu einer Einschränkung der staatlichen Einkommensumverteilung und zu einem Abbau sozialer Leistungen führt. Neben einer umfassenden theoretischen Diskussion wird der Zusammenhang von Globalisierung und Sozialpolitik empirisch untersucht. Dabei zeigt sich, dass eine Gefährdung des Sozialstaats vom zunehmenden internationalen Handel ausgeht, nicht aber vom stärker wachsenden internationalen Kapitalverkehr. Mit Hilfe von Ansätzen der Neuen Wirtschaftsgeografie kann dieses Ergebnis auch theoretisch erklärt werden.

Abstract
