Abstract

Centrelink was established in 1997 as part of the Howard government’s bold experiment in re-framing social policy and re-shaping service delivery. Centrelink was the embodiment of a key tenet of the Howard vision for public service: a specialised service delivery ‘provider’ agency separated from the policy functions of the ‘purchaser’. Carved out of a monolithic Department of Social Security, Centrelink was established along ‘business lines’ operating 320 service centres and delivering payments to 10 million Australians. Although enjoying ‘monopoly provider’ status, the organisation was required to deliver services to many different clients on behalf of its ‘purchasing departments’ (up to 25 in total) under the terms of quasi-contractual service agreements. It was meant to demonstrate a greater level of both transparency and accountability for the administration of payments amounting to over $60 billion of Commonwealth expenditure. For many years there was a real ‘buzz’ around the Centrelink experiment and staff and clients were generally enthusiastic about the transformation. However, after around eight years, the experiment was reined in and Centrelink was placed under closer ministerial direction and under a new managing department. The experiment continues, but its trajectory reflects the different pressures impacting on such dedicated ‘services delivery agencies’. John Halligan, Professor of Government at the University of Canberra, is a foremost Australian expert on public sector governance and has published extensively on the evolution, form and behaviour of the public sectors in Australia and overseas. This volume is the culmination of an exhaustive empirical study of the origins and experience of ‘the Centrelink Experiment’. Abstract

Crises, Criticism, and Sexual Deprivation The «Nacherziehung» (remedial upbringing) of male youth at the Aarburg facility, 1893-1981 The juvenile detention center Aarburg, founded in 1893, adhered superficially to an objective of separating juvenile offenders from adult offenders. From the beginning, however, roughly half of the inmates were institutionalized there in order to provide them with administrative maintenance. Power struggles soon after the institution opened, accusations of maltreatment and the suicide of two youths in the First World War era, the widely publicized critique of 1936 and the finally the “Heimkampagne” of 1970 are the focuses of this book. Source-based case studies sketch a nuanced picture of the daily life of the Aarburg institution across diverse decades, and the imponderability of interpersonal relations within the permanent emergency condition of a “total” institution. The author also devotes attention to the effects of sexual repression on the young inmates, which was not mentioned or addressed in official reports, making all the more striking, examples of this found within the archival sources analyzed here for the first time. The book offers insights into the quotidian experience of the inmates across the 20th century and also demonstrates the evolution of child-rearing techniques used on male juveniles.

Abstract

Que reste-t-il à dire sur la tolérance ? Panacée médiatique aux problèmes de société, elle est sommairement définie comme une “indulgence pour ce qu’on ne peut pas ou ne veut pas empêcher”. De l’acception de la tolérance comme affaiblissement de la norme au comportement pragmatique de l’administration qui renonce à appliquer une sanction, en passant par la tolérance comme composante d’une société démocratique, le concept brille par son hétérogénéité. Concept à la frontière du droit, de la science administrative, de la théorie du droit et parfois même de la philosophie du droit, il possède de très nombreuses applications sans avoir pour l’instant de définition strictement juridique. Ces actes de la journée d’étude, organisée par l’Institut Maurice Hauriou en collaboration avec l’Institut Fédératif de Recherche, ont pour vocation de décliner ce concept en le confrontant à d’autres objets dans toutes les branches du droit public (droit administratif, droit fiscal, libertés publiques...).

Abstract

The present dissertation addresses the manifold legal aspects of the administrative and constitutional problems of accreditation in german institutions of higher education. Issues are raised in respect to well-known questions concerning the legal nature of accreditation, as well as to the related encroachment upon fundamental rights. Furthermore, new challenges such as system accreditation and the seldom debated issues concerning the contractual relationships of the involved parties, or the democratic legitimation of the accreditation administration and the legal nature of its decisions are discussed. The study also draws comparisons to similarly structured areas of law - in so doing, further questions of modernisation in higher education, the debate surrounding privatisation and legal aspects of the administrative organisation are commented on.

Abstract

La historia de la rama iusadministrativa en Cuba no puede contarse bien sin la evocación de los autores que han sustanciado el pensamiento jurídico-administrativo y la literatura especializada en que es vertido parte de ese pensamiento. Si nos remitimos a la etapa en que el régimen jurídico-administrativo moderno comenzaba a echar sus raíces decimonónicas dentro del entramado del Derecho cubano, como consecuencia de la acción del poder colonial español que dominaba a la entonces “siempre fiel Isla de Cuba”. En 1847, el exiguo panorama bibliográfico que tenía lugar en Cuba sobre la temática jurídica, vio incorporarse en él, como nuevo elemento, una obra cuya denominación es Breve tratado de Derecho Administrativo español general del reino y especial de la isla de Cuba, y que tiene por autor a José María Morilla. El hecho de haberse publicado dicho texto marca un punto de significación dentro de la historia del Derecho Administrativo cubano. ¿Cuál es esa significación? ¿Qué características rodean a dicho texto? ¿Qué trascendencia puede acompañarle?

Abstract

The Slovenian constitution guarantees local self-government to all inhabitants and local self-government can be executed in municipalities and other local communities. Although municipalities are foundational units of local self-government, they experience some very basic problems since the re-establishment in the middle of 1990s; those problems are closely connected with inadequate exercise of subsidiarity and connection principles from in 1996 ratified European charter of local self-government. Slovenia has larger number of undersized municipalities that report problems with normative overload and their administrative incapacity. According to the findings of empirical study presented in the paper, the latter is often the case in municipalities smaller than 5000 inhabitants. The authors are also analysing inadequately defined scope of municipal jurisdiction; Slovenian municipalities are currently responsible for local affairs that affect only municipal inhabitants, and that narrow scope of jurisdiction is in many cases causing problems in managing the municipality, especially in cases of smaller municipalities.

Abstract

"Internationally, the case of early modern Sweden is noteworthy because the state building process transformed a locally dispersed and sparsely populated area into a strongly centralized absolute monarchy and European empire at the beginning of the 17th century. This anthology provides fresh insights into the state-building process in Sweden. During this transitional period, many far-reaching administrative reforms were carried out, and the Swedish state developed into a prime example of the early modern ‘powerstate’. The contributors approach Sweden’s rise to greatness from the point of view of personal agency. In early modern studies, agency has long remained in the shadow of the study of structures and institutions. This novel approach enables us to expose the difficulties, setbacks and false steps that the administration had to deal with. State building was a more diversified and personalized process than has previously been assumed. Numerous individuals were also crucially important actors in the process, and that development itself was not straightforward progression at the macro-level but was intertwined with lower-level actors. Each chapter in this volume employs partially different methods depending on the source material and subject. This means that both qualitative and quantitative material is combined, different ways of making sense of it (i.e. research traditions) are brought together and a multi-method design is used in analyzing source material. One of the central methods is the systematic use of previous biographical research. We want to give the individuals and their actions under discussion a background that reflects the contemporary structures of individual life cycles. With the existing biographical research, it is possible to create a comprehensive set of data that provides the general outlines of individual lives or the career tracks of various estates or social groups, and even to construct collective biographies of certain groups."
