Abstract

This book looks at the important issues in British politics since 1945, including a brief guide to the changing political culture of Britain in that period. It will be essential reading for all students studying politics at A2 level, as it covers all the important issues required by the main examining boards. Neil McNaughton is a seasoned writer at this level. He begins by reviewing the changing nature of the principal political ideologies - Conservatism, Labourism and Liberalism - before discussing how these ideological changes impact generally on policy developments in the UK. Having described the changing nature of the political culture, addressing partisan dealignment, changing morality, the decline of religion and class fragmentation, he examines, on a chapter by chapter basis, the key issues of British politics today: the economy, the welfare state, law and order, race relations, the particular problems affecting Northern Ireland, devolution, constitutional reform, rights, the environment, issues of gender and sexual orientation, European integration and the European Union, the impact of the European Union on Britain, ending with a brief summary of the issues that are likely to take centre stage in British politics in the first decade of the new century. Written in an accessible style, with helpful features such as summaries, definitions, tables and boxes to illuminate the points made, this book is urgently needed as students grapple with the issues thrown up by the new examinations.

Abstract

La VIe République est une revendication quasi concomitante à la mise en place de la constitution du 4 octobre 1958. Depuis cette date, le projet d ’une révision radicale des institutions n 'a cessé de prospérer dans toutes les formations de l’échiquier politique, à droite comme à gauche, amenant successivement la plupart des leaders politiques à afficher, à titre individuel ou partisan, leurs intentions. Les candidats aux présidentielles 2007 ont été sommés de prendre position et d’avancer des propositions, qu’elles soient réformistes ou de rupture. Le débat institutionnel devrait ainsi, selon les commentateurs, être au cœur des prochaines campagnes électorales. Cette émulation de la créativité constitutionnelle, sous les sunlights des médias, n’a guère amélioré la lisibilité des modèles proposés et elle n’a pas davantage permis de dégager un consensus dans la société française sur le vent des réformes souhaitables et souhaitées. C’est donc dans ce contexte d’affaiblissement des institutions de la Ve République, qu’Henry Roussillon et Stéphane Mouton ont eu la très heureuse et opportune idée d’organiser, en avril 2006, un colloque sur “Demain, la VIe République ?” ce qui a permis de dégager, entre les participants, un certain nombre de convergence : une lecture très critique des institutions de la Ve République, l’appel à un changement profond du régime et du système politiques à défaut de justifier le changement de numérotation de la République, la nécessité de ramener le Président de la République au strict rôle arbitral qu’il n’aurait jamais dû cesser d’exercer, enfin le constat que nul ne prétend changer la politique en changeant de constitution. En même temps, quelques lignes de tension ont discrètement sous-tendu les interventions : tensions entre expertise technique et démocratie : la place du savoir expert et la place du citoyen profane ; tensions entre réforme institutionnelle et révolution conceptuelle : ce que l’ingénierie constitutionnelle sait résoudre et ce qui lui échappe ; tensions entre constitutionnalisme et politique : ce que le droit peut résoudre et ce qui résulte des urnes, le fait majoritaire ayant largement hanté les débats.

Abstract

The aim of the present volume is to discuss the notion of constitution from the perspectives of history of political thought. Its scholarly intention is to go beyond the approach concentrating on the formal understanding of constitution and bring forward more complex historical and philosophic-political interpretations. Our point of departure was the need to revive the somehow neglected distinction between the idea of constitution as an act of conscious law-giving activity and the notion of constitution conceived as the set of fundamental political rules derived from the very nature of political regime and its historical development.

Abstract

In the view of the increasingly strong and far-reaching international interdependence of the national legal system, the question as to where the German Basic Law relates concerning the increasing international complexity is becoming ever more important. In response to this, the German Basic Law is said to be a constitution open to international law, which is extracted from the basic principle of ‘Völkerrechtsfreundlichkeit’ (friendliness toward international law). However, it remains vague in which relation such a principle would stand to the rule of law, the principle of democracy or the system of basic rights, if it is inserted into their limitations or constitutes a supreme premise. The focus of this study lays upon the attempt to make the principle of Völkerrechtsfreundlichkeit tangible and to explore its legal content of.

The structure comprises a tripartite division between: articles; country reports; and shorter commentaries on recent regional and sub-regional developments.The African Disability Rights Yearbook aims to advance disability scholarship. Abstract

In “The implementation of modern African Constitutions: challenges and prospects”, the authors try to identify obstacles to constitutional implementation in Africa and, on the basis of good practice, assess how this could be overcome. A single volume like this cannot unravel the complexity of the causes and effects of, and solutions to, the problem of non-implementation of constitutions in Africa: the subject is far too intricate. Nevertheless, this study, represents a first attempt to draw attention to the issue, and hopes to open a serious debate about it and pave the way for making this issue an integral consideration in constitution-building in the future. The variety of perspectives provided in analysing the challenges to constitution-implementation in this volume should make it to appeal to academics, practitioners, policy makers and postgraduate research students interested in the intricacies of comparative African constitutional law.

Abstract

The reception and popularity of the work of Emmanuel Joseph Sieyès has gone through different and erratic phases. Nonetheless, in recent years there has been a remarkable revival of interest in the Abbé's thought. This book is intended to exploit this Sieyès-renaissance, proposing a reconstruction of the constitutional doctrine of the abbot in the light of the latest interpretative acquisitions. The guiding thread of the analysis is the acknowledgement that, underlying the main political-constitutional proposals of Sieyès, we can glimpse a profoundly rationalist philosophical substructure. After presenting the nucleus of this philosophical approach, the book proceeds to shed light on the coherence linking the main constitutional structures upon which the abbot was working in the course of the early years of the Revolution. It focuses in particular on the concepts that contributed to make up the basic grammar of modern and liberal constitutionalism: representation, citizenship, constituent power, rights of man, the division of the powers and the control of constitutionality. The idea is that, by pursuing this approach, it is possible to arrive at an overall picture of the constitutional doctrine of the abbot that reflects both its systematic quality and its originality.

Abstract

The Constitution of the Democratic Republic of Timor-Leste of 2002 contains over 40 human rights provisions in its Bill of Rights. In addition to providing an overview of the process leading up to the adoption of the Constitution, this book brings together information relating to each section of the Bill of Rights, presenting: progressive texts produced during the process of the Constituent Assembly; highlights of the arguments put forward within the Constituent Assembly concerning the draft provisions, including alternative proposals advanced; submissions made by Timorese officials, civil society and international bodies; and the results of consultation with the broader community before and during the constitutional process. It is designed to be useful in particular to judges and legal practitioners called upon to interpret the Constitution, government officials and civil society actors involved in human rights work, as well as students of history and constitutional law in Timor-Leste and internationally.
