Abstract

This volume addresses important issues to do with access to higher education and different models of its financing in the East Asia region. It is enriched by diverse perspectives from vastly different starting points and by the historical and institutional settings in the region. The issues are set out in the context of the value of higher education in economic development and how it contributes to the capacities to adopt and adapt to new technologies and undertake institutional innovation. The established and well-functioning higher education loan and financing systems, such as those in Australia, and the experience of different systems tried—both in East Asia and in the United States—are brought to bear in this volume.

Abstract

The book analyses the results of a large scale victimisation survey that was conducted in 2005-06 with businesses in Hong Kong, Shanghai, Shenzhen and Xi’an. It also provides comprehensive background materials on crime and the criminal justice system in China. The survey, which measured common and non-conventional crime such as fraud, IP theft and corruption, is important because few crime victim surveys have been conducted with Chinese populations and it provides an understanding of some dimensions of crime in non-western societies. In addition, China is one of the fastest-growing economies in the world and it attracts a great amount of foreign investment; however, corruption and economic crimes are perceived by some investors as significant obstacles to good business practices. Key policy implications of the survey are discussed.

Abstract

Multiple relationships exist between antimicrobial resistance and bacterial virulence, and the spread of clones combining multiple antibiotic resistance and a high virulence level is an increasing problem. It was previously described how mutation-driven or horizontally acquired resistance mechanisms can also have effects on virulence. It was also reported that mobile genetic elements often carry both resistance determinants and virulence-modulating genes, which favors the co-selection of both traits. In the present volume, we present a collection of articles which document additional aspects of the interactions between antimicrobial resistance and virulence in bacteria, and describe their potential therapeutic consequences.

Abstract

Since Estonia regained its independence on 20 August 1991 Estonian civil procedure has been gradually developed from the civil procedure of Estonian SSR to the modern civil procedure rules in force today. The current code of civil procedure was adopted on 20 April 2005 and came into force in 1 January 2006. Since coming into force several changes have been made to the current code with significant changes coming into force on 1 January 2009. Estonian civil procedure is mainly based on the adversarial principle, except for some specific cases and proceedings on petition where the inquisitorial principle is used. Deriving from this the parties are in most cases free to decide on what evidence to submit and whether to submit evidence at all. While the court may ask the parties to submit evidence, they are not required to do so. The situation is different in cases based on the inquisitorial principle. Estonian civil procedure does not impose many restrictions as to the kind of evidence that can be submitted. Virtually anything that can be reproduced in some way may be submitted as documentary evidence and any person who has knowledge about the facts of the case may be heard as a witness. Even the parties may be heard under oath. The Estonian Code of Civil Procedure does not set out many rules on how to evaluate the evidence submitted. The basic rule is that the court has to assess the evidence impartially and as a whole and not give any preference to any particular piece of evidence.

Abstract

Presented here are scientific reports which add considerable information to the area of early stage ovarian cancer detection and the application of this detection to ovarian cancer screening. In this volume, the following presentations are made:1) The performance of different ultrasound-based International Ovarian Tumor Analysis (IOTA) strategies is analyzed to discriminate between early stage ovarian malignancy and benign abnormalities of the ovary.2) Since oophorectomy confers protection against ovarian cancer, when adjustment for oophorectomy was made, rates of ovarian cancer were substantially higher.3) The frequency of symptoms relevant to ovarian cancer was found to be more than two-hundred times higher than the occurrence of ovarian cancer and it was found that 80.1% of women expressed confidence in the symptoms they reported.4) Complications resulting from surgery performed in the Kentucky Ovarian Cancer Screening Program were infrequent and significantly fewer than reported in the Prostate, Lung, Colorectal and Ovarian Cancer Screening trial. Complications observed were mostly minor (93%) and were more common in cancer versus non-cancer surgery.5) Arguments in favor of serial ultrasonography as an alternative to immediate surgery are presented and illustrate the benefits of surveillance.6) Ten critical considerations for ovarian cancer screening are presented in depth, highlighting their important bearing on ovarian screening outcomes and their interpretations.7) Considerations that have psychological and behavioral impacts on individuals participating in ovarian screening suggest that a “normal” screening test result can have psychological benefits, including an increased positive effect and beliefs in the efficacy of screening.8) The efficacy of ovarian cancer screening may be higher in Asia than in Europe and the USA. Additionally, the re-analysis of PLCO screening data, when cancers presenting more than one year after screening are excluded, shows a significant survival benefit in the PLCO screening trial.9) The effect that ovarian cancer has on patients and their families is examined from the perspective of a first-year resident in Obstetrics and Gynecology.10) The 50-year history of biomarkers and ultrasound in the context of ovarian cancer indicates the importance of serial application of both biomarkers and ultrasound. Taken together, this volume provides both original data and overviews of ovarian cancer screening studies that enhance the present interpretation of this type of screening.

Abstract

This open access book is the first comparative study of public, voluntary and private asylums in nineteenth-century Ireland. Examining nine institutions, it explores whether concepts of social class and status and the emergence of a strong middle class informed interactions between gender, religion, identity and insanity. It questions whether medical and lay explanations of mental illness and its causes, and patient experiences, were influenced by these concepts. The strong emphasis on land and its interconnectedness with notions of class identity and respectability in Ireland lends a particularly interesting dimension. The book interrogates the popular notion that relatives were routinely locked away to be deprived of land or inheritance, querying how often “land grabbing” Irish families really abused the asylum system for their personal economic gain. The book will be of interest to scholars of nineteenth-century Ireland and the history of psychiatry and medicine in Britain and Ireland.&#xD;&#xD;

Abstract

A prominent solution to control a company’s internal complexity is a modular product architecture. The implementation of a modular structure comes with high effort and cost. During the application phase these expenditures are compensated. However, a modular structure does not remain stable throughout its lifetime. Decisions on new modules have to be made. Therefore, a new method to support variant decisions on module, module variant and product level has been designed.

Abstract

This book enhances economic methods for social cost-benefit analysis of air pollution control measures at point emission sources. A new and highly resolved health damage cost assessment framework is developed and applied, notably in order to evaluate the influence of site-dependent and generic methodological choices. Several of these are shown to have a major impact on resulting health damage costs with important implications for decision-making.

Abstract

This book portrays evidence and gathering of evidence under the current Croatian regulation relating to evidence and in practice. In this context, the author first analyses the fundamental principles of Croatian civil procedure and law of evidence. Then, the general principles of evidence and gathering of evidence are discussed, as well as the general rule on the burden of proof. The question of gathering of evidence through modern technology (videoconferencing, etc.) in the Croatian law and practice is also discussed. Separate parts of this book contain the analysis of means of proof regulated by the Croatian Civil Procedure Act: inspection of object ('view'), documents, witness testimony, expert testimony, and party testimony. The rules on costs caused by gathering of evidence, including the costs for translation are analysed, as well as the rules on language. The concepts of illegally obtained evidence and illegal evidence in the Croatian law and practice are discussed. This volume contains the report about the Council Regulation (EC) No 1206/2001 and the multilateral and bilateral legal assistance treaties to which Croatia is a party. There are several appendices to this book: a table of authorities according to the Regulation No 1206/2001, and relevant sources of Croatian civil procedure, table of case law on evidence, table portraying a ordinary/common civil procedure timeline, table referring to legal interpretation in the Croatian legal system, and comparative tables focusing on functional differences between national regulation, bilateral legal assistance treaties, multilateral treaties, and Council Regulation (EC) No 1206/2001 on taking of evidence by hearing of witnesses. This book is a result of the Dimensions of Evidence in European Civil Procedure research project commissioned by European Commission, Directorate-General Justice.
