Abstract

Markenrechtsverletzungen beeinträchtigen die mit Markenrechten einhergehenden sozioökonomischen Vorteile für Produzenten, Händler, Verbraucher und die Allgemeinheit. Die vorliegende Untersuchung setzt sich mit Fragen der subjektiven Tatseite im Markenstrafrecht auseinander. Dazu entwickelt der Verfasser zunächst ein grundlegendes allgemeines System der strafrechtlichen subjektiven Zurechnung. Dieses wird sodann zur Lösung der Probleme der subjektiven Tatseite bei Markenstraftaten ausgearbeitet. Dabei werden die Einflüsse nicht nur der spezifischen markenstrafrechtlichen Besonderheiten eingehend durchleuchtet, sondern auch diejenigen der rechtstatsächlichen Aspekte des Markenstrafrechts wie etwa dessen Zugehörigkeit zur organisierten internationalen Wirtschaftskriminalität und die im Markenstrafrecht begegnenden Tätergruppen. Schließlich erörtert der Verfasser die relevanten Gesichtspunkte einer Inkriminierung von fahrlässigen Markenrechtsverletzungen de lege ferenda.

Abstract

This book contains some of the papers that were presented at the first meeting of the newly formed African Expert Study Group on International Criminal Law / Groupe des Experts Africaines en Droit Pénal International held in September 2011 in Brussels, Belgium. The group was established under the auspices of the Multinational Development Policy Dialogue (hereinafter ‘MDPD’) and the Rule of Law programme of the German Konrad-Adenauer-Stiftung (‘KAS’) in 2010 modeled on the successful sister group in Latin America. This latter group was originally founded as an expert group to monitor the implementation of the Rome Statute of the International Criminal Court (‘ICC’) in Latin America within the framework of cooperation between KAS’ regional Rule of Law Programme and the Department for Foreign and International Law of the Institute for Criminal Law and Criminal Justice of the Georg-August-Universität Göttingen in 2002. The newly formed African group consists of judicial experts with both academic and practical background from various parts of Sub-Saharan Africa. The importance of such a group for the African continent cannot be overestimated. Africa plays a vital role in international criminal law and justice, both as an active player at the ICC and at the regional and national level. As for the group’s composition and outreach, the aim is to broaden regional representation and further consolidate membership. In 2012, the group will meet in Nairobi, Kenya to deal with topics surrounding the ‘Potential for the domestic prosecution of international crimes in Africa.’ Topics for future meetings abound given the multi-faceted African legal and political practice regarding international criminal justice in general and the ICC in particular. The group should in particular monitor the recent international or transnational criminal justice developments at the regional African level as well as relevant national developments. Abstract

Recidivism belongs to the main categories of criminology, crime policy and criminal justice. If the target of preventing offenders from reoffending is taken seriously crime policy should be measured by success of certain penal sanctions in terms of relapses. Also institutions that deal directly with crime and offenders need to get basic information on the consequences of their actions; particularly general knowledge about offender groups at risk of reoffending. All these are reasons why representative recidivism studies are needed. Meanwhile a lot of European countries gather systematic and comprehensive information on recidivism, periodically and on a national level. This volume presents an exemplary collection of such endeavors: Austria, Estonia, France, Germany, Switzerland and a comparative study of England and Wales, the Netherlands and Scotland.

Abstract

Absprachen im Strafprozess werden seit vielen Jahren in Politik, Rechtsprechung und Rechtswissenschaft umfassend und kontrovers diskutiert. Auch das „Gesetz zur Regelung der Verständigung im Strafverfahren“ hat die Diskussion nicht verstummen lassen. Die vorliegende Untersuchung würdigt dieses Gesetz unter Her-anziehung ausgewählter, alternativer Lösungsmodelle aus dem In- und Ausland. Berücksichtigung finden die Rechtsordnungen von England & Wales, Frankreich und Polen. Abstract

Grappling with uncertainties is at the heart of investigating serious crime. At a time when such crime is becoming more complex and resources are increasingly stretched, this book draws together research and practice perspectives to review fruitful approaches to uncertainties and to chart the way forward. Scene setting chapters describe the consequences of globalisation and the spread of sophisticated information technologies (Sue Wilkinson), as well as advances in understanding and managing uncertainty (Michael Smithson). Ways of enhancing responses from statistics (Robyn Attewell), risk analysis (Richard Jarrett and Mark Westcott) and the psychology of decision making (Mark Kebbell, Damon Muller and Kirsty Martin) follow. Abstract

The book analyses the results of a large scale victimisation survey that was conducted in 2005-06 with businesses in Hong Kong, Shanghai, Shenzhen and Xi’an. It also provides comprehensive background materials on crime and the criminal justice system in China. The survey, which measured common and non-conventional crime such as fraud, IP theft and corruption, is important because few crime victim surveys have been conducted with Chinese populations and it provides an understanding of some dimensions of crime in non-western societies. In addition, China is one of the fastest-growing economies in the world and it attracts a great amount of foreign investment; however, corruption and economic crimes are perceived by some investors as significant obstacles to good business practices. Key policy implications of the survey are discussed.

Abstract

This book analyzes heroin users and the drug subculture on the Shetland Islands, an area known for its geographical remoteness, rural character and relative wealth. It fills the scientific gap created by the conventional research in heroin research, which is usually conducted in urban areas and relies on treatment and prison populations. Based on qualitative, in-depth interviews with twenty-four heroin users, this book depicts and analyzes the nature and historical development of the local heroin scene. It illustrates the features and internal structures of the subculture, and it examines the manner in which both are influenced by the location-specific geographical, cultural and socio-economic conditions. It thus reveals complex causal associations that are hard to recognize in urban environments. Complete with a list of references used and recommendations for future research, this book is a vital tool for progressive and pragmatic approaches to policy, intervention and research in the field of illicit drug use.
