Abstract

This volume’s purpose is making standards of basic employment law, accessible to everybody, even to non-lawyers.This book is part of the “Una finestra sul mondo del lavoro” project of University of Milano – Bicocca. The project is promoted by the Students’Association of Bicocca and the Left Wing List. This book is part of the “A window on the world of work” project of University of Milano – Bicocca. The project is promoted by the Students’Association of Bicocca and the Left Wing List. Within this project, graduate students of the Faculty of Law, practitioners and young lawyers specialized in employment law, have joined theirskills to create a platform of labour law training for students. This work does not aim to academically and comprehensively treat these subjects: it is rather moved by the spirit of giving to all, non-lawyers as well, the ability to access the raw information to understand the regulation of their employment contract.

Abstract

What do we know about the current realities of work and its likely futures? What choices must we make and how will they affect those futures? Many books about the future of work start by talking about the latest technology, and focus on how technology is going to change the way we work. And there is no doubt that technology will have huge impacts. However, to really understand the direction in which work is going, and the impact that technology and other forces will have, we need to first understand where we are. This book covers topics ranging from the ‘mega-drivers of change’ at work, power, globalisation and financialisation, to management, workers, digitalisation, the gig economy, gender, climate change, regulation and deregulation. In doing this, it refers to some of the great works of science fiction. It demolishes several myths, such as that the employment relationship is doomed, that we are all heading to becoming ‘freelancers’ or ‘gig workers’ one day, that most jobs will be destroyed by technological change, that the growth in jobs will mainly be in STEM fields, that we will no longer value collectivism as we will all be ‘individuals’, or that the death of unionism is inevitable. The Realities and Futures of Work also rejects the idea of technological determinism—that whatever will be, will be, thanks to technological change—and so it refuses to accept that we simply need to prepare to adapt ourselves to the future by judicious training since there is nothing else we can do about it. Instead, this book provides a realistic basis for thinking about both the present and the future. It emphasises the choices we make, and the implications of those choices for the future of work.

Abstract

Flexicurity is a European policy agenda seeking to increase both flexibility and security in the labour-market. This book argues that it needs a revision: Although flexicurity is set out to change the way Europeans work and live, and even though it is being justified by workers’ needs, flexicurity lacks of a clear and democratically justified vision of society. Flexicurity is confronted here with Amartya Sen’s capability-approach, a paradigm of well-being evaluation. How is flexicurity related to a concept of employment as part of a way of life which people have reason to value? How capability-friendly are established flexicurity-indicators? It is thus shown how the capability-approach can be used in the field of labour-market and social policy.

Abstract

Precarious Creativity examines the seismic changes confronting media workers in an age of globalization and corporate conglomeration. This pathbreaking anthology peeks behind the hype and supposed glamor of screen media industries to reveal the intensifying pressures and challenges workers face. The authors take on crucial issues and provide insightful case studies of workplace dynamics regarding creativity, collaboration, exploitation, and cultural difference. Furthermore, they investigate working conditions and organizing efforts on all six continents, offering comprehensive analysis of contemporary screen media labor in places such as Lagos, Prague, Hollywood, and Hyderabad, across a range of job categories that includes visual effects, production services, and adult entertainment. With contributions from John Caldwell, Vicki Mayer, Herman Gray, Tejaswini Ganti, and others, this collection offers timely critiques of media globalization and broader debates about labor, creativity, and precarity.

Abstract

Youth and the Politics of the Present presents a range of topical sociological investigations into various aspects of the everyday practices of young adults in different European contexts. Indeed, this volume provides an original and provocative investigation of various current central issues surrounding the effects of globalization and the directions in which Western societies are steering their future.Containing a wide range of empirical and comparative examples from across Europe, this title highlights how young adults are trying to implement new forms of understanding, interpretation and action to cope with unprecedented situations; developing new forms of relationships, identifications and belonging while they experience new and unprecedented forms of inclusion and exclusion. Grounding this exploration is the suggestion that careful observations of the everyday practices of young adults can be an excellent vantage point to grasp how and in what direction the future of contemporary Western societies is heading.Offering an original and provocative investigation, Youth and the Politics of the Present will appeal to students and researchers interested in fields such as Youth Studies, Globalization Studies, Migration Studies, Gender Studies and Social Policy.

Abstract

This collection of essays arose from a conference held to mark the silver anniversary of the Australian Sex Discrimination Act (1984). The collection has two aims: first; to honour the contributions of both the spirited individuals who valiantly fought for the enactment of the legislation against the odds, and those who championed the new law once it was passed; secondly, to present a stock-take of the Act within the changed socio-political environment of the 21st century. The contributors present clear-eyed appraisals of the legislation, in addition to considering new forms of legal regulation, such as Equality Act, and the significance of a Human Rights Act. The introduction of a proactive model, which would impose positive duties on organisations, is explored as an alternative to the existing individual complaint-based model of legislation. The contributors also pay attention to the international human rights framework, particularly the Convention on the Elimination of all Forms of Discrimination against Women and the UN Declaration on the Rights of Indigenous People. The essays are illuminated by recourse to a rich vein of historical and contemporary literature. Regard is also paid to the comparative experience of other jurisdictions, particularly the UK and Canada.

Abstract

Fighting for a Living investigates the circumstances that have produced starkly different systems of recruiting and employing soldiers in different parts of the globe over the last 500 years. It does so on the basis of a wide range of case studies taken from Europe, Africa, America, the Middle East and Asia. The novelty of "Fighting for a Living" is that it is not military history in the traditional sense (concentrating at wars and battles or on military technology) but that it looks at military service and warfare as forms of labour, and at the soldiers as workers. Military employment offers excellent opportunities for this kind of international comparison. Where many forms of human activity are restricted by the conditions of nature or the stage of development of a given society, organized violence is ubiquitous. Soldiers, in one form or another, are always part of the picture, in any period and in every region. Nevertheless, Fighting for a Living is the first study to undertake a systematic comparative analysis of military labour. It therefore speaks to two distinct, and normally quite separate, communities: that of labour historians and that of military historians. This title was made Open Access by libraries from around the world through Knowledge Unlatched.

Abstract

Book, written in Slovene, discusses the legal content and scope of the concept of discriminatory harassment, which is deemed to be an unlawful discrimination under modern EU non-discrimination law, in the context of implementation of provisions of relevant EU directives in legal systems of the United Kingdom and Ireland. the two most important EU non-discrimination directives, adopted under Article 13 of the Treaty Establishing the European Community (now Article 19 of the treaty on the Functioning of the European union) - Racial Equality Directive (Directive 2000/43/EC) and Employment Framework Directive (Directive 2000/78/EC) - explicity mention harassment as prohibited form of discrimination. Legal definitions contained in these two directives define harassment as discriminationdiscrimination itself. Prior to the transposition of the EU non-discrimination directives into their laws, while few member states tackled this issue either within the context of the law on equal treatment (e.g. Denmark, the United Kingdom and Ireland) or outside this context (e.g. France), that is in the framework of criminal, civil, health and safety or employment legislation. As a result of the implementation of relevant provisions of the two main non-discrimination directives (Directives 200/43/EC and 200/78/EC) a definition of harassment has been included in legislations of all EU member states. In most member states such legislative definition is a literal copy of the definition of harrasment that can be found in the Directives 2000/43/EC and 2000/78/EC. The approach to the definition of harassment that appears to be the most "generous" from the perspective of victims of discriminatory harrasment is the one that was taken by British legislator. Such legal position in respect of the prohibition of discrimination has been developed in British case law and is based on the extensive interpretation of non-discrimination laws.
