Abstract

La experiencia de los derechos humanos se manifiesta a través de luces y sombras, pues los derechos adquieren su forma en un complejo juego de reflejos en el cual las exigencias de emancipación se enlazan con las lógicas de dominio. Desde un punto de vista fenomenológico, los derechos parecen estar atravesados por una dicotomía a través de la cual la universalidad no modifica (quizás consolida) el hecho de su inefectividad, la generalidad no resuelve (quizás esconde) dinámicas discriminadoras, la multiplicación más que paz social produce contraposición. Los regímenes jurídicos de los derechos se interesan también por la transformación del mismo proceso de producción; esto deriva de una complicación de la relación entre política y justicia: al mismo tiempo que la política se judicializa, la justicia se politiza. Los profundos cambios presentes en el mundo contemporáneo, que configuran un nuevo espacio geopolítico y un inédito pluralismo de los valores en un contexto de diversidad cultural, actúan como factores que modifican el sentido del discurso de los derechos humanos. Los análisis contenidos en este volumen se desarrollan sobre distintas áreas jurídicas y filosóficas. Partiendo del examen directo de algunas cuestiones clave, ponen de relieve esos problemas complejos y señalan la urgente necesidad de una reflexión sobre las posibles vías para corresponder a las reivindicaciones de libertad y de justicia expresadas en la demanda de los derechos.

Abstract

Combines an overview of the key theoretical models of democracy and human rights with a state-of-the-art survey which reports on trade-offs between achievements, set-backs and challenges in some of the world's 'hotspots'. The 20th century has been described as the bloodiest in human history, but it was also the century in which people around the world embraced ideas of democracy and human rights as never before, constructing social, political and legal institutions seeking to contain human behaviour. Todd Landman offers an optimistic, yet cautionary tale of these developments, drawing on the literature, from politics, international relations and international law. Abstract

Switzerland was not content to stay on the sidelines of the CSCE (Conference on Security and Cooperation in Europe) negotiations. Particularly in the area of human rights policies and by applying its talent for successful mediation between East and West, Switzerland achieved great recognition, as Philip Rosin`s thoroughly researched and methodologically persuasive study clearly reveals.

Despite consistent claims of neutrality, Vienna supported the Western position on all important questions. Benjamin Gilde's broadly researched study offers major insight into the history of the humanitarian aspect of the CSCE.

Abstract

According to the Chinese zodiac, 2018 was the year of the ‘earthly dog’. In the middle of the long, hot, and feverish dog days of the summer of 2018, some workers at Shenzhen Jasic Technology took their chances and attempted to form an independent union. While this action was met by the harshest repression, it also led to extraordinary demonstrations of solidarity from small groups of radical students from all over the country, which in turn were immediately and severely suppressed. China’s year of the dog was also imbued with the spirit of another canine, Cerberus—the three-headed hound of Hades—with the ravenous advance of the surveillance state and the increasing securitisation of Chinese society, starting from the northwestern region of Xinjiang. This Yearbook traces these latest developments in Chinese society through a collection of 50 original essays on labour, civil society, and human rights in China and beyond, penned by leading scholars and practitioners from around the world.&#xD;

The biography and work of Fred Vondracek are inseparable. The contributions of the authors who have had the privilege of being close to the research and the life of Fred Vondracek provide a clear picture of him as an exemplary paradigm of the concept of person in context. His agency in contexts of dramatic structural changes and transitions in society are representative of both his personal experience and his scientific position. Fred ‘s ability to bring new insights into the field of developmental psychology has opened our minds to the need for new research paradigms, which his colleagues and followers testify to in this book. Abstract

This book offers a devastating look at deeply flawed development processes driven by international finance, African governments and the global consulting industry. It examines major river basin development underway in the semi-arid borderlands of Ethiopia, Kenya and South Sudan and its disastrous human rights consequences for a half-million indigenous people. The volume traces the historical origins of Gibe III megadam construction along the Omo River in Ethiopia—in turn, enabling irrigation for commercial-scale agricultural development and causing radical reduction of downstream Omo and (Kenya's) Lake Turkana waters. Presenting case studies of indigenous Dasanech and northernmost Turkana livelihood systems and Gibe III linked impacts on them, the author predicts agropastoral and fishing economic collapse, region-wide hunger with exposure to disease epidemics, irreversible natural resource destruction and cross-border interethnic armed conflict spilling into South Sudan. The book identifies fundamental failings of government and development bank impact assessments, including their distortion or omission of mandated transboundary assessment, cumulative effects of the Gibe III dam and its linked Ethiopia-Kenya energy transmission 'highway' project, key hydrologic and human ecological characteristics, major earthquake threat in the dam region and widespread expropriation and political repression. Violations of internationally recognized human rights, especially by the Ethiopian government but also the Kenyan government, are extensive and on the increase—with collaboration by the development banks, in breach of their own internal operational procedures. A policy crossroads has now emerged. The author presents the alternative to the present looming catastrophe—consideration of development suspension in order to undertake genuinely independent transboundary assessment and a plan for continued development action within a human rights framework—forging a sustainable future for the indigenous peoples now directly threatened and for their respective eastern Africa states. Claudia Carr’s book is a treasure of detailed information gathered over many years concerning river basin development of the Omo River in Ethiopia and its impact on the peoples of the lower Omo Basin and the Lake Turkana region in Kenya. It contains numerous maps, charts, and photographs not previously available to the public. The book is highly critical of the environmental and human rights implications of the Omo River hydropower projects on both the local ethnic communities in Ethiopia and on the downstream Turkana in Kenya. Abstract

The postcolonial states of Fiji, Papua New Guinea and Vanuatu operate today in a global arena in which human rights are widely accepted. As ratifiers of UN treaties such as the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child, these Pacific Island countries have committed to promoting women’s and girls’ rights, including the right to a life free of violence. Yet local, national and regional gender values are not always consistent with the principles of gender equality and women’s rights that undergird these globalising conventions. This volume critically interrogates the relation between gender violence and human rights as these three countries and their communities and citizens engage with, appropriate, modify and at times resist human rights principles and their implications for gender violence. Grounded in extensive anthropological, historical and legal research, the volume should prove a crucial resource for the many scholars, policymakers and activists who are concerned about the urgent and ubiquitous problem of gender violence in the western Pacific.
