Abstract

Le cas de la Malaisie est particulièrement révélateur de l’influence politique et économique croissante de la Chine sur l’Asie du Sud-Est. Le rapprochement entre la Malaisie et la Chine, longtemps entravé par des divergences idéologiques, s’est renforcé au cours de cette dernière décennie. Dans un contexte d’intégration régionale de l’Asean sur fond de conflits territoriaux en mer de Chine méridionale, l’examen de leur relation prend ses distances avec l'idée d'une simple manœuvre hégémonique chinoise et révèle une alliance porteuse de nombreux bénéfices réciproques. Trois spécialistes de la Malaisie – une économiste, une géographe et un sociologue – décryptent ici les multiples facettes de cette « précieuse » relation du point de vue malaisien. Leur enquête montre comment, au cours de la période 2008-2016, cette alliance a été méthodiquement construite sur la base de partenariats déployés dans des secteurs économiques clés et sur des territoires stratégiques. Elle interroge les rapports d’État à État, les dimensions socioculturelles des échanges bilatéraux et les enjeux liés aux gigantesques projets d’aménagement immobiliers et aux investissements industriels. Cette analyse éclaire les logiques du déploiement de l'activité chinoise en Malaisie autant que les efforts du parti conservateur malais pour en tirer bénéfice.

Abstract

Cette étude consacrée au soft power sud-coréen, autrement qualifié de « puissance douce », permet de mieux comprendre un aspect méconnu du développement des échanges entre la Corée du Sud et les pays du sud-est asiatique. Il s’agit ici d’appréhender, en particulier, les liens qui se sont tissés entre la démarche prosélyte d'une Église pentecôtiste et l’expansion de la présence sud-coréenne au sein de la région. Les actions menées par l'Église du Plein Évangile doivent être comprises en relation avec les efforts entrepris ces dernières années par le gouvernement et les grandes entreprises sud-coréennes afin de véhiculer une « bonne image » de la Corée du Sud et de faciliter les échanges avec les différents pays d’Asie du Sud-Est. Cette politique s'inscrit dans une démarche de long-terme fondée sur des sphères d’influences partagées issues des univers politiques, économiques et culturels. C'est en effet dans cette optique que l'on peut s'interroger sur la mise en place de « stratégies d’influences sud-coréennes ». L'analyse précise de l’organisation et des activités de cette institution religieuse permet ainsi de mieux saisir l'articulation entre ces réseaux d’influences multiples, souvent analysés séparément, et de souligner le rôle de cette Église dans la mise en scène d’une représentation « fantasmatique » de la réussite du modèle de développement sud-coréen.

Abstract

The concept of "hidden payout of profit” is characteristic for tax law, but inappropriate for corporate law, although it became deep-rooted in this field by practice. Within the context of corporate law it is not only about the problem of profit payouts, but also about the protection of the so-called tied up assets of a capital company within the so-called principle of capital preservation. The purpose of the corporate legislation is to prevent inadmissible interferences of shareholders or associates in the company's assets. Unlike corporate law, the purpose of tax law is to protect (fiscal) interests of the state, primarily to protect the tax base of the company as an independent and only subject to taxation, therefore the payouts of profit don’t have an effect on the amount of the tax base, irrespective of whether the company pays out the profit in an open or hidden way. Hidden payouts of profit - as the open ones - do not reduce the tax base for income. The subject of the discussion are both aspects - the corporate aspect of hidden transfers of assets and the tax aspects of hidden transfers of assets within the law of joint-stock companies and limited liability companies.

Abstract

Infrastructure Investment in Indonesia: A Focus on Ports presents an important and original collation of current material investigating the efficient facilitation of major infrastructure projects in Indonesia and Australia, with an emphasis on infrastructure investment and a focus on port planning and development.This interdisciplinary collection—spanning the disciplines of engineering, law and planning—draws helpfully on a range of practical and theoretical perspectives. Abstract

This special issue provides a collection of 15 papers with modern theories and applications for circular economy, engineering projects, entrepreneurship models, and investor decisions. After the commencing review on Occupational Health and Safety Management-Systems Standards, follow papers which can be classified into four categories which cover the overall scope of special issue. The first category includes papers regarding the micro-level of circular economy. This means case studies in firm-level which implement different techniques to achieve sustainable development and circular economy goals. The findings reveal interesting achievements which are associated with cultural characteristics of the countries these case studies have been conducted. The second category of papers refers to the meso-level of circular economy where firms cooperate with each other by exchanging byproducts and organizing common operational procedures and routines to address environmental problems. The findings suggest assessment information technology tools to support industrial symbiosis among European firms. The next body of literature encompasses macro-level where circular economy techniques are implemented at a country level. Findings suggest methodologies for implementing and tracking circular economy in cities. Finally, a number of papers are included that focus on advanced engineering techniques. These techniques are useful tools for achieving circular economy and sustainability.
