Abstract

Die jüngsten Entwicklungen im Strafverfahrensrecht sind durch die strafprozessuale Auslegungsdoktrin der Beschleunigung, Effektivierung und Verbilligung geprägt. Vor dem Hintergrund dieser Entwicklung werden die Vorschriften der §§ 154, 154a StPO als bedeutende Ausformung der verfahrensrechtlichen Beschleunigungsmaxime einer umfassenden rechtsstaatlichen und verfahrensrechtlichen Analyse unterzogen. Die Normen der §§ 154, 154a StPO begrenzen das strafprozessuale Legalitätsprinzip aufgrund von Opportunitätserwägungen und dienen der Konzentration des Verfahrensstoffes. Das öffentliche Interesse an einem prozessökonomischen und ressourcenschonenden Strafverfahren findet seine Grenze jedoch dort, wo das Beschleunigungsstreben zu einer Verletzung des Beschuldigten in seinen prozessordnungsgemäßen Rechten und der Rechtsstaatlichkeit führt. Es stellt sich daher die Frage, ob diese Praxis den rechtsstaatlichen und verfahrensrechtlichen Anforderungen an das Strafverfahren genügt oder gerade keine Berechtigung dafür besteht, dass – bildlich in den Worten von Peters (StV 1981, 411 (412)) gesprochen – „die Justiz zwar den guten Tropfen (Verfahrensbeschleunigung, Entlastung, möglicherweise, wenn auch sicherlich die Ausnahme: Umgehung eines Freispruchs) genießt, den bösen Tropfen (Unschuldsvermutung, Ausschaltung des ausgesonderten Teils bei der Restbeurteilung) jedoch nicht schlucken will“.

Abstract

"Vision traditionally occupies the height of the sensorial hierarchy. The sense of clarity and purity conveyed by vision, allows it to be explicitly associated with truth and knowledge. The law has always relied on vision and representation, from eye-witnesses to photography, to imagery and emblems. The law and its normative gaze can be understood as that which decrees what is permitted to be and become visible and what is not. Indeed, even if law’s perspectival view is bound to be betrayed by the realities of perception, it is nonetheless productive of real effects on the world. This first title in the interdisciplinary series ‘Law and the Senses’ asks how we can develop new theoretical approaches to law and seeing that go beyond a simple critique of the legal pretension to truth. This volume aims to understand how law might see and unsee, and how in its turn is seen and unseen. It explores devices and practices of visibility, the evolution of iconology and iconography, and the relation between the gaze of the law and the blindness of justice. The contributions, all radically interdisciplinary, are drawn from photography, legal theory, philosophy, and poetry."

Abstract

"Economic and sociological research has long shown that the widespread presence of criminal organizations in the territory is a factor that contrasts economic and social development. This is just one aspect of the complex relationship that exists between local economic dynamics and the illegal behavior of social actors. The relationship between social norms and legal norms, the quality and quantity of social capital, the bonds of trust between the actors and the legitimization of the state, the local power systems, the certainty of the sanctions, are other aspects that certainly contribute to create the conditions that favor illegal responses to the crisis. The book seeks to highlight how legality and illegality present facets and interdependencies that can't simply be traced back to the moral categories of good and evil, but need to be analyzed in a multifactorial perspective."

Abstract

The Tyrolean knight Oswald von Wolkenstein (ca 1376 - 1445) is considered to be the most important German poet and composer of the Late Middle Ages. Besides his songs and compositions more than 1000 documents bear evidence of his chivalrous career and the medieval life of the lower nobility in all its social, economic and legal details. This exceptional historical attestation came down to us in ca 40 archives spread all over Austria, Italy, Germany and neighbouring countries. Partly known and with exceptions not published before this five volume edition presents the material in a totally new edition following the rules of historic-diplomatic editions, based on new transcriptions and accompanied by source descriptions as well as ample commentaries. Volume IV comprises the years 1438 to 1442, a period that shows how Wolkenstein is establishing himself as a leading member oft Tyrolean nobility, renown as legal adviser as well as a land-owner involved in arguments.

Abstract

While the first volume presented a younger son of a family of Tyrolese nobility, who strived after social advancement throughout Europe and who succeeded to act the part of a special advisor in service of the sovereign, the documents of his life in the second volume concentrate primarily on feuds, captivities and resolution of conflicts in Tyrol. The conflict over the heritage of Hauenstein leads to captivity, provisional release, appeal to the king, further imprisonment and humiliating submission to the duke of Tyrol. Finally Oswald is granted a reprieve and acquires the property of Hauenstein.
