Abstract

This study analyses legal barriers to data sharing in the context of the Open Research Data Pilot, which the European Commission is running within its research framework programme Horizon2020. In the first part of the study, data protection issues are analysed. The main focus is on the Data Protection Directive (95/46/EC) and its implementation in selected EU Member States. Additionally, the upcoming General Data Protection Regulation (2016/679/EU) and relevant changes are described. Special focus is placed on leading data protection principles. Next, the study describes the use of research data in the Open Research Data Pilot and how data protection principles influence such use. The experiences of the European Commission in running the Open Research Data Pilot so far, as well as basic examples of repository use forms, are considered. The second part of the study analyses the extent to which legislation on public sector information (PSI) influences access to and re-use of research data. The PSI Directive (2003/98/EC) and the impact of its revision in 2013 (2013/37/EU) are described. There is a special focus on the application of PSI legislation to public libraries, including university and research libraries, and its practical implications. In the final part of the study the results are critically evaluated and core recommendations are made to improve the legal situation in relation to research data.

Abstract

In 2010 the Panton Principles for Open Data in Science were published. These principles were founded upon the idea that 'Science is based on building on, reusing and openly criticising the published body of scientific knowledge’ (http://pantonprinciples.org) and they provide a succinct list of the fundamentals to observe when making your data open. Intended for a broad audience of academics, publishers and librarians, Issues in Research Data explores the implications of the Panton Principles through a number of perspectives on open research data in the sciences and beyond. The book features chapters by open data experts in a range of academic disciplines, covering practical information on licensing, ethics, and advice for data curators, alongside more theoretical issues surrounding the adoption of open data. As the book is open access, each chapter can stand alone from the main volume so that communities can host, distribute, build upon and remix the content that is relevant to them. Readers can access the online version via the QR code or DOI link at the front of the book. (DOI: http://dx.doi.org//10.5334/ban)

Abstract

These Study Review and Proposals have been designed to structure and facilitate the implementation of the Act: they therefore concur with the positions adopted by the sponsors of the White Paper Open Science in a Digital Republic, who all clearly wish to associate this new vision for research with practices that will enable it to become a reality. As a supplementary report to the White Paper, these Guidelines aim to assist players in what are often complex procedures: researchers, technician...

Abstract

Recent years have witnessed considerable speculation about the potential of open data to bring about wide-scale transformation. The bulk of existing evidence about the impact of open data, however, focuses on high-income countries. Much less is known about open data’s role and value in low- and middle-income countries, and more generally about its possible contributions to economic and social development.Open Data for Developing Economies features in-depth case studies on how open data is having an impact across the developing world-from an agriculture initiative in Colombia to data-driven healthcare projects in Uganda and South Africa to crisis response in Nepal. The analysis built on these case studies aims to create actionable intelligence regarding: (a) the conditions under which open data is most (and least) effective in development, presented in the form of a Periodic Table of Open Data; (b) strategies to maximize the positive contributions of open data to development; and (c) the means for limiting open data’s harms on developing countries.

Abstract

It’s been ten years since open data first broke onto the global stage. Over the past decade, thousands of programmes and projects around the world have worked to open data and use it to address a myriad of social and economic challenges. Meanwhile, issues related to data rights and privacy have moved to the centre of public and political discourse. As the open data movement enters a new phase in its evolution, shifting to target real-world problems and embed open data thinking into other existing or emerging communities of practice, big questions still remain. How will open data initiatives respond to new concerns about privacy, inclusion, and artificial intelligence? And what can we learn from the last decade in order to deliver impact where it is most needed? The State of Open Data brings together over 60 authors from around the world to address these questions and to take stock of the real progress made to date across sectors and around the world, uncovering the issues that will shape the future of open data in the years to come.
