Abstract

During the First World War, conflicts between the people’s sacrifices and their political participation led to crises of parliamentary legitimacy. This volume compares British, German, Swedish and Finnish debates on revolution, rule by the people, democracy and parliamentarism and their transnational links. The British reform, although more about winning the war than advancing democracy, restored parliamentary legitimacy, unlike in Germany, where Allied demands for democratisation made reform appear treasonous and fostered native German solutions. Sweden only adopted Western political models after major confrontations, but reforms saw it embark on its path to Social Democracy. In Finland, competing Russian revolutionary discourses and German- and Swedish-inspired appeals to legality brought about the deterioration of parliamentary legitimacy and a civil war. Only a republican compromise imposed by the Entente, following a royalist initiative in 1918, led to the construction of a viable polity.

Abstract

The consequences of globalization for the world's poor are uncertain and fierce rhetoric is dividing its supporters and detractors. The channels of effect of essentially macroeconomic shocks on the microeconomic position of individuals and households in poor countries are many and various. This book addresses three core issues: 1) what are the main channels of effect? 2) what are the lessons to be learned from policy measures to alleviate negative poverty consequences? and 3) do the proposed analytical approaches assist in providing a monitoring capability? This volume assesses the more easily quantifiable effects resulting from price and quantity responses in the goods and labour markets. It includes studies of Colombia, Ghana, India, Nepal, Bangladesh and Vietnam. It uses key analytical approaches, most of which are based on numerical simulation methods employing models with different levels of complexity. These models capture the features of an economy, how it functions, and how it might respond to globalization shocks. The most important collective contribution of the authors is their establishment of directions and magnitudes of effect, based on empirical evidence.

Abstract

The first reactions to the Greek financial crisis were pension reforms and reductions. The aim of this book is to assess the legal implications of the reductions to pension benefits, proposing a legal framework in which pensioners are able to raise legal claims in court. The book gives account of the background regarding the factors that necessitated pension reforms prior to and after the fiscal crisis. Furthermore, it describes the Greek pension reforms and reductions which were undertaken progressively by the Greek Parliament from the beginning of the crisis until the year 2012. Finally, it examines the legality of the public pension reforms and reductions in old-age pension benefits with the Greek Constitution and with international law. The assessment is achieved using the principle of proportionality as a balancing concept.

Abstract

Romania is an active player in various international higher education areas, while undergoing a series of higher education reforms within its national framework. The Higher Education Evidence Based Policy Making: a necessary premise for progress in Romania project was implemented by the Executive Agency for Higher Education, Research, Development and Innovation Funding (UEFISCDI) in the timeframe February 2012 – February 2014, being co-financed by the European Social Fund through the Operational Programme “Administrative Capacity Development”. The project aimed to increase the capacity of public administration for evidence-based policy making in the field of higher education, while focusing on good practices at international level and impact assessment. With the contribution of the national and international experts, the project has generated a number of analysis and studies on the existing higher education public policies (quality assurance, internationalisation, equity, data collection, the Bologna Process, financing of higher education). Based on the results of the project, the book will reunite a number of policy research articles which would tap into the innovative aspects of the project's activities and provide a concise overview of what good practices can be drawn from the empirical research conducted in this project. The book will therefore aim to improve the information on Romanian higher education reforms, as well as on the concrete evidence-based policy proposals which could be transformed into future policy solutions in the Romanian higher education system.

Abstract

Bankenstrukturreformen, die eine Trennung von Investment- und Retailbanking vorsehen und die zusammenfassend als „Ring-Fencing“ bezeichnet werden können, werden seit der Finanzkrise kontrovers diskutiert. Die Arbeit befasst sich mit den rechtlichen Entwicklungen in der Europäischen Union sowie mit Regelungen im Vereinigten Königreich, Deutschland und der Schweiz.Die Arbeit trägt zur Abgrenzung und der Systematik von Ring-Fencing-Regelungen bei und zeichnet ein umfassendes Bild der gegenwärtigen Entwicklungen sowie möglicher Perspektiven auf Ebene des Unionsrechts. Darüber hinaus untersucht sie strukturelle Unterschiede zwischen bestehenden nationalen Regelungen an Europas drei wichtigsten Finanzplätzen und geht dabei insbesondere auf die einzigartigen aber bisher international wenig beachteten Schweizerischen Ring-Fencing-Bestrebungen ein.Die Arbeit wurde unter anderem mit dem Österreichischen Preis für Insolvenzrecht ausgezeichnet.Bank structural reforms that stipulate the separation of retail and investment banking and that can collectively be referred to as ‘ring-fencing’ have been among the most controversial regulations since the financial crisis. This study explores legal developments in the European Union in this regard as well as national legislation in the United Kingdom, Germany and Switzerland.The study contributes to the terminology and classification of existing and future ring-fencing initiatives and paints a comprehensive picture of current developments and prospects on an EU level in this respect. It furthermore highlights structural differences in the national approaches of Europe’s three most important financial centres, and casts light on Switzerland’s unique ring-fencing efforts that have been barely recognised internationally.This study was recognised with the Austrian Award for Insolvency Law.

Abstract

The study describes the process of gradual inclusion of the Jews into the ‚Heimatrecht‘ and citizenship in the Austrian monarchy since the Josephine reforms. The stony path of integration of the Jews into general citizenship which spans centuries and is marked by numerous setbacks allows to shed new light on the act of expatriation of the Austrian Jews during the Nazi regime.The stony path of integration of the Jews into general citizenship spans many centuries and is marked by numerous setbacks. It stretches from special royal protection of the Jews ('Judenregal') via Tolerance or 'Familienstelle' all the way to full citizenship. A description of this development allows to shed new light on the previously dimly lit act of expatriation of the Austrian Jews during the Nazi regime. 

This was a complex process running in several stages which, although similar to the rest of the German Reich, occurred at a somewhat later stage and already under the sign of flight and expulsion. However, the disenfranchisement and – literally and legally - depersonalization of the Austrian Jews was - so the argument - not just an act of targeted Nazi persecution, but the systematic reversal in rapid motion of the Jews' emancipation which had started at the end of the 18th century. 

What at first glance appears to have been an abstruse and cluttered convolution of Nazi regulatory activity turns out, on closer analysis, to have been a meticulous reversal of the historical process of 'Jewish emancipation'. Numerous case studies and three major biographical studies towards the end of the book show to what extent the 'Heimatrecht' and citizenship or, by contrast, the fate of statelessness determined the lives and identities of people - far beyond the time of the Austrian monarchy.
