Abstract

To several governments, modern international terrorism cannot be handled adequately within the ordinary criminal justice system. To fight terrorism (including the criminalization of certain “abstract danger”, preparatory activities such as terrorist training, membership in a terrorist organization) more effectively, criminal law had to be adapted.

Abstract

"Terrorism. 9/11 in Context" is an anthology of thematic priorities that aims to establish a better understanding of the complexities of terrorism aside from one-dimensional characterisations in media and politics. The main focal points are: The definition of terrorism, its causes, mythological charging and pop cultural realization. Reactions of the state towards the terrorist challenge - the political, military and security aspects as well as media counter strategies - are also of keen interest. Further, as case-studies from the US, Latin America and Europe clearly demonstrate the state can also be a perpetrator of terrorism, either during covert operations or by adopting the mirror image of guerrillas and terrorists in counter insurgency warfare. The main thread of "Terrorism. 9/11 in Context" is the analysis of the "superstructure"- the symbolic and ideological sources of terrorism. Terrorist violence is seen as commitment for radical political change, which is fuelled not only by political and social grievances, but also by the gratification of a radical-action identity. Thus, terrorism is most of all the product of a powerful idea, which motivates and stimulates activists, giving them the strong conviction needed to follow through their "project". It's the idea that not only is it possible to wage resistance against an alleged illegitimate, corrupt authority; it is also possible to inspire others to participate in an avant-garde armed struggle. On the other hand, the perspective of politicians and authorities on the terrorist enemy is also influenced to a certain degree by imagination and projection - this process is analysed through the depiction of terrorism in cinema, media and the imitation of terrorist tactics by counter terrorism forces.

Abstract

On 20 September 2001, in an address to a Joint Session of Congress and the American people, President George W Bush declared a ‘war on terror’. The concept of the ‘war on terror’ has proven to be both an attractive and a potent rhetorical device. It has been adopted and elaborated upon by political leaders around the world, particularly in the context of military action in Afghanistan and Iraq. But use of the rhetoric has not been confined to the military context. The ‘war on terror’ is a domestic one, also, and the phrase has been used to account for broad criminal legislation, sweeping agency powers and potential human rights abuses throughout much of the world. This collection seeks both to draw on and to engage critically with the metaphor of war in the context of terrorism. It brings together a group of experts from Australia, Canada, the United Kingdom, France and Germany who write about terrorism from a variety of disciplinary perspectives including international law and international relations, public and constitutional law, criminal law and criminology, legal theory, and psychology and law.

Abstract

This study is principally concerned with the ethical dimensions of identity management technology – electronic surveillance, the mining of personal data, and profiling – in the context of transnational crime and global terrorism. The ethical challenge at the heart of this study is to establish an acceptable and sustainable equilibrium between two central moral values in contemporary liberal democracies, namely, security and privacy. Both values are essential to individual liberty, but they come into conflict in times when civil order is threatened, as has been the case from late in the twentieth century, with the advent of global terrorism and trans-national crime. We seek to articulate legally sustainable, politically possible, and technologically feasible, global ethical standards for identity management technology and policies in liberal democracies in the contemporary global security context. Although the standards in question are to be understood as global ethical standards potentially to be adopted not only by the United States, but also by the European Union, India, Australasia, and other contemporary liberal democratic states, we take as our primary focus the tensions that have arisen between the United States and the European Union.

Abstract

Abstract

Eric Frécon's study starkly reveals the fragility of the internal societies and the inadequate regulation of the Asian region by boldly plunging into a reality- that of piracy- that during the Cold War had been habitually restricted to notes of secret agents or for the reports of some original journalists. The study is an interesting approach. The development of terrorism has in fact confirmed it: a major part of the current scenario which matters now is that of the underground, economic, mafia-like or terrorist forces, forces that are beyond control and of which sometimes the nations are fully aware. Piracy is therefore an important phenomenon today; its analysis allows us to measure the power of the nations and the regulation of international zones. But the investigation is difficult and calls for intelligence, passion, the audacity to search in the dark and the courage to not be taken in: these are the very qualities that this work embodies. This book constitutes an excellent photograph of the weaknesses but also of the recovery of the Asians. It explains how piracy reappeared massively after the Cold War, firstly on account of the general deficiencies of the region and the weaknesses (or tactics) of some nations. But it also shows that the region has evolved. When I brought it up in 1998 in “L'Asie en danger”, piracy was partially imputable to the internal situation and to the foreign policy of China. Since then, the collapse of Indonesia and the recovery of the Chinese regime have pushed it back towards the Straits of Southeast Asia. Eric Frécon's book also describes how the efforts of regional coordination and the policies of certain big nations like Japan and India acted upon piracy, in order to contain it, on the whole. The problem seems to have, since then, been identified and to a large extent handled; one may hope that it will be resolved in the years to come, even though the Indonesian crisis may seriously impede regulation efforts.

Abstract

The past years were characterized by a massive influx of migrants crossing the Union’s external borders seeking asylum. Illegal migration, exploitation of social welfare systems, foreign infiltration and the instrumentalization of religion condensed in terror attacks determine today’s changed attitude towards foreigners, refugees and migrants and therefore strongly impact the current European political agenda. Angelika C. Dankert describes the development of the EU and provides information on events that led to the creation and the spill-over of the Arab Spring. Roots and origin of Jihadist ideology as well as goals of religiously motivated terrorism are illustrated and European standards on morals and values are critically questioned. Through investigation of current matters in the field of law, security and interculturality, this book reveals the biggest geopolitical challenge of the 21st century.

Abstract

This book addresses two developments in the conceptualisation of citizenship that arise from the »war on terror«, namely the re-culturalisation of membership in a polity and the re-moralisation of access to rights. Taking an anthropological perspective, it traces the ways in which the trans-nationalisation of the »war on terror« has affected notions of »the dangerous other« in different political and social contexts, asking what changes in the ideas of the state and of the nation have been promoted by the emerging culture of security, and how these changes affect practices of citizenship and societal group relations.
