Abstract

About the publicationCourt rooms are frightening places for anyone testifying. Even adults are fearful about giving evidence in front of magistrates and judges, and about being questioned by prosecutors and defence lawyers. Imagine how much more scary that must be for a child. Even worse, in sexual offences children have to talk about embarrassing things, for which they do not even have an adequate or accurate vocabulary. South African law has excellent provisions which allow children to testify via intermediaries and in separate rooms, so that they need not encounter the offender. But this is only as good as the provisioning allows. In the 2009 case of Director of Public Prosecutions v the Minister of Justice and Constitutional Development, the Court laid emphasis on these special arrangements, and at the time directed the Minister of Justice to place a report before the Constitutional Court on the readiness of the courts to provide the specialised services. Five years on, this report looks at the statistical evidence that is currently available, coupled with empirical evidence gathered from visits to sexual offences court, to determine how much progress has been made towards the goal of children being able to testify in a safe, child-friendly environment.About the authors:The Centre for Child Law was established in 1998 and is based in the Faculty of Law at the University of Pretoria. Abstract

This volume discusses the effects, models and implications of history teaching in relation to conflict transformation and reconciliation from a social-psychological perspective. Bringing together a mix of established and young researchers and academics, from the fields of psychology, education, and history, the book provides an in-depth exploration of the role of historical narratives, history teaching, history textbooks and the work of civil society organizations in post-conflict societies undergoing reconciliation processes, and reflects on the state of the art at both the international and regional level. As well as dealing with the question of the ‘perpetrator-victim’ dynamic, the book also focuses on the particular context of transition in and out of cold war in Eastern Europe and the post-conflict settings of Northern Ireland, Israel and Palestine and Cyprus. Abstract

In the vast literature on how the Second World War has been remembered in Europe, research into what happened in communist Poland, a country most affected by the war, is surprisingly scarce. The long gestation of Polish narratives of heroism and sacrifice, explored in this book, might help to understand why the country still finds itself in a «mnemonic standoff» with Western Europe, which tends to favour imagining the war in a civil, post-Holocaust, human rights-oriented way. The specific focus of this book is the organized movement of war veterans and former prisoners of Nazi camps from the 1940s until the end of the 1960s, when the core narratives of war became well established.

Abstract

Since its inception in 2001, the International Criminal Court (ICC) has been met with resistance by various African states and their leaders, who see the court as a new iteration of colonial violence and control. In Affective Justice Kamari Maxine Clarke explores the African Union's pushback against the ICC in order to theorize affect's role in shaping forms of justice in the contemporary period. Drawing on fieldwork in The Hague, the African Union in Addis Ababa, sites of postelection violence in Kenya, and Boko Haram's circuits in Northern Nigeria, Clarke formulates the concept of affective justice—an emotional response to competing interpretations of justice—to trace how affect becomes manifest in judicial practices. By detailing the effects of the ICC’s all-African indictments, she outlines how affective responses to these call into question the "objectivity" of the ICC’s mission to protect those victimized by violence and prosecute perpetrators of those crimes. In analyzing the effects of such cases, Clarke provides a fuller theorization of how people articulate what justice is and the mechanisms through which they do so.

Abstract

Despite the significant decrease in bullying that has been reported in many countries during the last two decades, bullying continues to be a significant problem among young people. Given the increase of internet use among youth, researchers have started to pay attention to cyberspace, understanding that it may be a fertile ground for bullying behaviors, specifically, what is known as cyberbullying. “Family, Bullying and Cyberbullying” examines the association of several family variables with bullying in offline and online environments during childhood and adolescence. Contributors from the Americas, Canada, Asia, and Europe offer cutting-edge research on family dynamics, bystander behaviors, parents’ and educators’ perceptions, and bullying and cyberbullying prevention and intervention strategies of bullying for school and home.
