Abstract

Das Verhältnis von Arbeitsrecht und Zivilrecht in Japan und Deutschland war Thema des siebten gemeinsamen Symposiums der Japanisch-Deutschen Gesellschaft für Arbeitsrecht und ihrer deutschen Schwestergesellschaft, der Deutsch-Japanischen Gesellschaft für Arbeitsrecht am 3. und 4. September 2012 an der Universität Meiji, Tokyo. Den Ausgangspunkt des Austauschs bildeten die in diesem Band versammelten Referate. Die Vorträge der japanischen Referenten geben nicht nur Auskunft über neue Entwicklungen in Japan, sie informieren zudem über Grundzüge des japanischen Zivil- und Arbeitsrechts. Der Rechtsvergleich zwischen Japan und Deutschland gibt wertvolle Erkenntnisse für die Fortentwicklung des Arbeitsrechts. Die gesellschaftlichen Herausforderungen, vor denen Japan und Deutschland stehen, sind in vielem ähnlich.

Abstract

Over the course of the past decades, photography has become one of the most popular fields of art. This development is also reflected in recent prices for some works of contemporary photography, which fetch up to several million dollars. Such price levels would be unheard of if artists were to take advantage of the opportunity to produce as many prints from the same negative as possible. On the contrary, the prevailing practice in contemporary photography is that of printing photographs in “limited editions”, with some of the most expensive photographs only existing in the low single digits. This study researches the legal implications of artists communicating limited editions to the purchasers of their art with the main question being whether such “promises of exclusivity” are legally binding and thus could be enforced by collectors e. g. in court proceedings.

Abstract

The special rules on unjust enrichment and damages in intellectual property law are subject of a discussion where representatives of civil law criticise them as incoherent in the general system of civil law and representatives of intellectual property law justify this incoherence with their practical utility. This book shows that it is important to bring general civil law in dialogue with the rules of “special private law” in order to link practical utility and theoretical coherence and to realize pragmatic solutions for certain cases within the frame of a coherent legal system.
